31:26:04

COURT CLERK: Good morning. Would you solemnly swear that the testimony you shall give to the court and the jury in the matter now pending between the Commonwealth and the defendant at the bar shall be the truth, the whole truth, and nothing but the truth, so help you God?

41:26:14
51:26:14

COURT CLERK: Thank you. You may have a seat now.

61:26:18

THE COURT: All right. Good morning, sir. I'm gonna ask you to speak into that microphone. You can be seated if you'd like. It'd be more comfortable. Okay. All right. Commonwealth, please.

71:26:29

MS. SPRAGUE: Thank you, Your Honor. Good morning. Can you please state and spell your name for the record?

81:26:34

PATRICK CLANCY: Yeah. My name's Patrick Clancy. It's P-A-T-R-I-C-K C-L-A-N-C-Y.

91:26:39

MS. SPRAGUE: And what is your date of birth?

101:26:41

PATRICK CLANCY: June 15th, 1988.

111:26:43

MS. SPRAGUE: What city do you live in now?

121:26:45

PATRICK CLANCY: New York.

131:26:46

MS. SPRAGUE: And what do you do for a living?

141:26:48

PATRICK CLANCY: I work in tech.

151:26:50

MS. SPRAGUE: How long have you worked in tech?

161:26:53

PATRICK CLANCY: 14 years.

171:26:57

MS. SPRAGUE: And were you previously married to a person named Lindsay Clancy?

181:27:01
191:27:02

MS. SPRAGUE: And you're divorced now, is that correct?

201:27:03
211:27:04

MS. SPRAGUE: Do you see that person in the courtroom today?

221:27:06
231:27:07

MS. SPRAGUE: Could you point to them and describe something they're wearing?

241:27:10

THE COURT: Just a moment.

251:27:11

PATRICK CLANCY: She's wearing a pink shirt.

261:27:13

THE COURT: All right. Record will reflect the identification of the defendant.

271:27:16

MS. SPRAGUE: Thank you. Where did you meet the defendant?

281:27:20

PATRICK CLANCY: In South Boston.

291:27:22

MS. SPRAGUE: And when was that?

301:27:24

PATRICK CLANCY: I think it was May 2013.

311:27:29

MS. SPRAGUE: And how did you meet her?

321:27:31

PATRICK CLANCY: Through my cousin.

331:27:33

MS. SPRAGUE: And would it be accurate to state that your cousin had been college roommates of the defendant?

341:27:38
351:27:41

MS. SPRAGUE: And at some point in time did you start dating?

361:27:44
371:27:45

MS. SPRAGUE: And around what time was that?

381:27:47

PATRICK CLANCY: July 2013.

391:27:50

MS. SPRAGUE: Did you eventually move in together?

401:27:52
411:27:53

MS. SPRAGUE: Do you remember when that was?

421:27:55

PATRICK CLANCY: September 2015.

431:27:57

MS. SPRAGUE: And where did you live?

441:27:59

PATRICK CLANCY: In Quincy.

451:28:02

MS. SPRAGUE: How long did you live in Quincy?

461:28:05

PATRICK CLANCY: One year.

471:28:06

MS. SPRAGUE: And where did you go after that?

481:28:08

PATRICK CLANCY: We bought a house in Weymouth.

491:28:10

MS. SPRAGUE: And how long did you live in Weymouth?

501:28:13

PATRICK CLANCY: Two years.

511:28:15

MS. SPRAGUE: Did you eventually get married?

521:28:16
531:28:17

MS. SPRAGUE: And when was that?

541:28:19

PATRICK CLANCY: December 2016.

551:28:21

MS. SPRAGUE: And was that while you were living in Weymouth?

561:28:25
571:28:27

MS. SPRAGUE: Did you have your first child when you were living in Weymouth?

581:28:30
591:28:31

MS. SPRAGUE: And what was her name?

601:28:32
611:28:33

MS. SPRAGUE: And what was her date of birth?

621:28:35

PATRICK CLANCY: December 24th, 2017.

631:28:43

MS. SPRAGUE: Prior to getting married, did the defendant ever tell you she had taken psychiatric medication while in nursing school?

641:28:50

PATRICK CLANCY: Not that I recall.

651:28:54

MS. SPRAGUE: After having Cora, did the three of you move somewhere else?

661:28:59

PATRICK CLANCY: Yeah, we moved to Duxbury.

671:29:01

MS. SPRAGUE: And what was your address in Duxbury?

681:29:03

PATRICK CLANCY: 47 Summer Street.

691:29:06

MS. SPRAGUE: And do you recall when you moved there?

701:29:09

PATRICK CLANCY: I believe it was July 2018.

711:29:13

MS. SPRAGUE: And where were you working at that time?

721:29:17

PATRICK CLANCY: I was working for a startup called Automation Anywhere.

731:29:20

MS. SPRAGUE: At some point in time did you start working for Microsoft?

741:29:24
751:29:24

MS. SPRAGUE: And when was that?

761:29:27

PATRICK CLANCY: May 2020.

771:29:29

MS. SPRAGUE: And when you worked for Microsoft, did you go to an office or did you work from home?

781:29:34

PATRICK CLANCY: I worked from home.

791:29:35

MS. SPRAGUE: And was that from 2020 onward that you worked from home?

801:29:40

PATRICK CLANCY: No, I started working from home in 2018.

811:29:42

MS. SPRAGUE: 2018, okay. So from 2018 up until, let's say, 2023, you were working from home. Is that correct?

821:29:50
831:29:54

MS. SPRAGUE: And did you have an office in your home which you worked out of?

841:29:58

PATRICK CLANCY: Eventually, yeah.

851:29:59

MS. SPRAGUE: Okay. And where was that located?

861:30:00

PATRICK CLANCY: In the basement.

871:30:02

MS. SPRAGUE: And was that a finished basement?

881:30:03
891:30:10

MS. SPRAGUE: Going back to after Cora was born, do you recall the defendant having any physical issues after the birth?

901:30:18
911:30:19

MS. SPRAGUE: And what were those?

921:30:21

PATRICK CLANCY: I think there was a lot of tearing, and she bled a lot.

931:30:27

MS. SPRAGUE: Did it take her a while to recover physically?

941:30:30

PATRICK CLANCY: I would say so, yeah.

951:30:31

MS. SPRAGUE: Okay. Did she have maternity leave at that time?

961:30:37
971:30:39

MS. SPRAGUE: Where was she working?

981:30:41

PATRICK CLANCY: Mass General Hospital.

991:30:42

MS. SPRAGUE: And what was she doing there?

1001:30:44

PATRICK CLANCY: She's a labor and delivery nurse.

1011:30:46

MS. SPRAGUE: At that point in time when she had Cora in 2017, how long had she been a nurse?

1021:30:55

PATRICK CLANCY: Three years maybe.

1031:30:58

MS. SPRAGUE: And do you recall how long her maternity leave was with Cora?

1041:31:05

PATRICK CLANCY: That was the shortest of the three. I wanna say it was 10 or 11 weeks.

1051:31:12

MS. SPRAGUE: And did you have paternity leave at that time?

1061:31:15

PATRICK CLANCY: Yeah, I had two weeks.

1071:31:16

MS. SPRAGUE: Two weeks, okay. When you went back after the two weeks back to work in the home, were there any issues that you noticed the defendant having?

1081:31:31

PATRICK CLANCY: Yeah. I'm sorry, I just wanna correct an earlier statement. I was working for Pegasystems when Cora was born.

1091:31:37
1101:31:37

MS. SPRAGUE: And then eventually you worked for Microsoft?

1111:31:40
1121:31:40

MS. SPRAGUE: Okay. And so after the two weeks of your paternity leave, the defendant was still on maternity leave, correct?

1131:31:47
1141:31:48

MS. SPRAGUE: Okay. And did she have to take any psychiatric medications at that time?

1151:31:54

PATRICK CLANCY: Not that I know of.

1161:31:56

PATRICK CLANCY: She had a lot of anxiety, but…

1171:31:58

MS. SPRAGUE: Okay. So you're saying that she had some anxiety at that time. Is that correct?

1181:32:02
1191:32:02

MS. SPRAGUE: How did that manifest, or how did you know that?

1201:32:05

PATRICK CLANCY: She just really struggled with the date of going back to work, so…

1211:32:11

MS. SPRAGUE: So immediately after having Cora, as she healed physically, what was her mood like when you're both on leave?

1221:32:21

PATRICK CLANCY: It was great. It was good.

1231:32:22

MS. SPRAGUE: Good. Okay.

1241:32:23

PATRICK CLANCY: I mean, relatively, yeah.

1251:32:25

MS. SPRAGUE: And so did the anxiety start as it became closer in time to when she had to go back to work?

1261:32:30
1271:32:32

MS. SPRAGUE: How many shifts was she working at that time?

1281:32:35

PATRICK CLANCY: Before Cora was born, she was working at least 40 hours, maybe more. After she went back to work, it was, I think, initially just one.

1291:32:49

MS. SPRAGUE: One shift?

1301:32:50
1311:32:51

MS. SPRAGUE: And was that a 12-hour shift?

1321:32:53

PATRICK CLANCY: It was per diem.

1331:32:54

MS. SPRAGUE: Per diem.

1341:32:55

PATRICK CLANCY: And then she eventually did two shifts.

1351:32:57
1361:32:57

PATRICK CLANCY: And I think it was 20 weeks.

1371:32:59

MS. SPRAGUE: After 20 weeks she moved to two shifts?

1381:33:03

PATRICK CLANCY: I'm sorry. It was 20 hours a week.

1391:33:06

MS. SPRAGUE: 20 hours a week, okay. And so from the time she worked her way back up to 20 hours a week at work until she had your next child, did it remain that 20 hours per week that she worked?

1401:33:19

PATRICK CLANCY: Pretty much, yeah.

1411:33:20

MS. SPRAGUE: Okay. And did you have any assistance in the home during that time after she went back to work, a nanny or a babysitter?

1421:33:30

PATRICK CLANCY: Yeah, we had babysitters. We had a babysitter who came probably 12 hours a week.

1431:33:38

MS. SPRAGUE: And did that typically happen after your wife had a shift, that the nanny or the babysitter would be there?

1441:33:45

PATRICK CLANCY: Yeah, so she could sleep.

1451:33:47

MS. SPRAGUE: Did the defendant work overnights?

1461:33:48
1471:33:52

MS. SPRAGUE: And how long did you have that nanny or babysitter for?

1481:33:58

PATRICK CLANCY: Several years.

1491:33:59

MS. SPRAGUE: Do you remember her name?

1501:34:01

PATRICK CLANCY: We called her Ms. Jen.

1511:34:02

MS. SPRAGUE: Ms. Jen. Do you remember her last name?

1521:34:05

PATRICK CLANCY: Shanahan.

1531:34:08

MS. SPRAGUE: And then you had a second child. Is that correct?

1541:34:10
1551:34:11

MS. SPRAGUE: And what was their name?

1561:34:12
1571:34:13

MS. SPRAGUE: And what was Dawson's date of birth?

1581:34:15

PATRICK CLANCY: September 30th, 2019.

1591:34:19

MS. SPRAGUE: And was Ms. Jen still helping out in the home at that time?

1601:34:24
1611:34:25

MS. SPRAGUE: And what was Dawson's delivery like?

1621:34:29

PATRICK CLANCY: Pretty traumatic.

1631:34:30

MS. SPRAGUE: How so?

1641:34:32

PATRICK CLANCY: He was in, I think, a breech position, so he came out in a, I guess, I don't, I don't know much about it, but not an ideal way. And it caused just significant bruising and tearing.

1651:34:49

MS. SPRAGUE: So again, did the defendant with this second pregnancy have some pain and difficulty physically healing from the birth?

1661:34:57

PATRICK CLANCY: Yeah, much more so than Cora.

1671:34:59

MS. SPRAGUE: Okay. And was she on maternity leave at that time?

1681:35:04
1691:35:04

MS. SPRAGUE: How many weeks leave did she have at that time?

1701:35:07

PATRICK CLANCY: I don't recall, but I think it was more than the, you know, traditional 12. I wanna say it was 13 or 14, maybe more.

1711:35:38

MS. SPRAGUE: Page 13. If I may approach.

1721:35:42

THE COURT: You may.

1731:35:42

MR. REDDINGTON: Judge, you don't have to keep telling me the pages. That's okay.

1741:35:46

MS. SPRAGUE: Okay. If I could have you look at page 13.

1751:35:49
1761:35:49

MS. SPRAGUE: And just read to yourselves lines six through 10, and then just look up when you're finished.

1771:36:03
1781:36:03

MS. SPRAGUE: Thank you.

1791:36:07

MS. SPRAGUE: Does that refresh your memory as to how much maternity leave the defendant had after Dawson's birth?

1801:36:13
1811:36:14

MS. SPRAGUE: And what was it?

1831:36:15

MS. SPRAGUE: 18 weeks?

1841:36:16
1851:36:17

MS. SPRAGUE: Is that correct?

1861:36:18

PATRICK CLANCY: I believe so.

1871:36:19

MS. SPRAGUE: Okay. And, you know, after dealing with the physical pain of birth and starting to heal, how was her demeanor and experience during that maternity leave?

1881:36:36

PATRICK CLANCY: I think it was fine at first. It was always when she had to go back to work, that's when she struggled. So...

1891:36:44

MS. SPRAGUE: Okay. So that was a pattern that you saw—

1901:36:46
1911:36:46

MS. SPRAGUE: ...after the baby, maternity leave was real good, and then she'd struggle going back to work?

1921:36:51

PATRICK CLANCY: She just had a really hard time being separated from them.

1931:36:57

MS. SPRAGUE: Okay. What was the plan for how many shifts she would work or how many hours she would work after Dawson was born?

1941:37:04

PATRICK CLANCY: I believe it was the same thing.

1951:37:09

MS. SPRAGUE: Okay. And in terms of Ms. Shanahan, the babysitter, you had mentioned before that she was there about 12 hours a week. Did that stay consistent after Dawson's birth, or was it more or less?

1961:37:23

PATRICK CLANCY: Probably consistent.

1971:37:30

MS. SPRAGUE: After Dawson's birth, are you... Did the defendant ever tell you whether she was on any psychiatric medication after Dawson's birth?

1991:37:39

MS. SPRAGUE: Did she seek treatment, or tell you she sought treatment after Dawson's birth?

2001:37:44

PATRICK CLANCY: Yeah. She got a therapist for a short period of time, but it didn't, didn't last very long.

2011:37:50

MS. SPRAGUE: Did she tell you that at the time or later?

2021:37:53

PATRICK CLANCY: At the time.

2031:37:54

MS. SPRAGUE: Okay. And did she have any psychiatric hospitalizations or commitments at that time?

2051:38:00

MS. SPRAGUE: What about after Cora's birth, any psychiatric hospitalizations or treatments?

2071:38:10

MS. SPRAGUE: Was there a time after Dawson's birth where she wanted to declutter your garage?

2081:38:20

PATRICK CLANCY: Maybe at some point.

2091:38:21
2101:38:22
2111:38:22

MS. SPRAGUE: And did you assist her with that?

2121:38:24
2131:38:25

MS. SPRAGUE: Okay. And how was that done?

2141:38:29

PATRICK CLANCY: We had a lot of stuff to throw away, and I think we sold some stuff on Facebook Marketplace. We just had a lot of stuff.

2151:38:37

MS. SPRAGUE: So did the two of you go through the items in the garage and organize it into what you would keep, what you would throw away, and what you would sell?

2161:38:45
2171:38:45

MS. SPRAGUE: Okay. And so it was very organized?

2181:38:49

PATRICK CLANCY: I would say so, yeah.

2191:38:52

MS. SPRAGUE: Okay. And you finished the project, is that correct?

2201:38:56

PATRICK CLANCY: It was always ongoing.

2211:39:02

MS. SPRAGUE: Now, eventually you had your third child, correct?

2221:39:05
2231:39:05

MS. SPRAGUE: And what was their name?

2241:39:07
2251:39:08

MS. SPRAGUE: And what was his date of birth?

2261:39:10

PATRICK CLANCY: May 26th, 2022.

2271:39:15

MS. SPRAGUE: Can you describe that delivery for us?

2281:39:19

PATRICK CLANCY: It was great from what I could tell. It was relatively quick. It was during the day. We were both smiling after, and I don't think there was as much physical trauma.

2291:39:36

MS. SPRAGUE: Nothing compared to what happened with Cora or Dawson, is that correct?

2301:39:39
2311:39:41

MS. SPRAGUE: Did the defendant have maternity leave after Callan's birth?

2321:39:48
2331:39:48

MS. SPRAGUE: And how long was that leave?

2341:39:50

PATRICK CLANCY: She never went back.

2351:39:52

MS. SPRAGUE: How long was it planned for initially?

2361:39:55

PATRICK CLANCY: I wanna say 18 weeks.

2371:39:57

MS. SPRAGUE: Okay. And were you on paternity leave as well?

2381:40:01
2391:40:01

MS. SPRAGUE: And how long was your paternity leave?

2401:40:03

PATRICK CLANCY: 12 weeks.

2411:40:06

MS. SPRAGUE: So with Callan being born on May 26, 2022, the two of you were home with the children that summer on leave. Is that correct?

2421:40:15
2431:40:21

MS. SPRAGUE: What was family life like during that time period, those summer months?

2441:40:27

PATRICK CLANCY: It was great. We had a lot of time off. I was able to spend a lot of time with— I spent a lot of time with Cora and Dawson. So I would take them around, you know, the playgrounds and birthday parties and stuff like that.

2451:40:42

MS. SPRAGUE: Okay. And what would Lindsay be doing while you were with Cora and Dawson?

2461:40:47

PATRICK CLANCY: Sometimes she'd come with us with Callan, but oftentimes we did kinda like a divide and conquer. So she'd be home with Callan, and I'd be out with the older kids.

2471:40:56

MS. SPRAGUE: And what types of family activities did you all do during those summer months?

2481:41:02

PATRICK CLANCY: We went on a couple vacations. We went to the beach. We went out on our boat.

2491:41:09

MS. SPRAGUE: Mm-hmm.

2501:41:09

PATRICK CLANCY: And went to friends' houses.

2511:41:13

MS. SPRAGUE: During those months, when you're going to the beach and out on the boat and visiting with friends, were there any signs of anxiety in the defendant during those months?

2521:41:25

PATRICK CLANCY: I would say starting in September, yes. But in the previous months, not so much.

2531:41:32

MS. SPRAGUE: When had she been scheduled to go back to work?

2541:41:36

PATRICK CLANCY: I don't remember the exact date, but I think it was October.

2551:41:38

MS. SPRAGUE: Okay. So again, it was that pattern of as it became closer in time to go back to work—

2561:41:43
2571:41:43

MS. SPRAGUE: ... she started to struggle?

2581:41:45
2591:41:54

MS. SPRAGUE: During the times when she would get anxious, when it was time to go back to work and she would start being anxious, did you ever have any difficulty understanding her when she spoke?

2611:42:07

MS. SPRAGUE: And did she ever exhibit any behavior that made you concerned enough to call a doctor or want to commit her, commit her?

2631:42:21

MS. SPRAGUE: When she was showing this anxiety, what were you seeing in her behavior?

2641:42:28

PATRICK CLANCY: Just a lot of stress. You know, it was that there were days where she had all three kids and, you know, there's different nap schedules and different needs. So it was just really stressful.

2651:42:41
2661:42:46

MS. SPRAGUE: And you're still working in the basement office at this point after Callan's born, correct?

2671:42:52

PATRICK CLANCY: I went back to work late August.

2681:42:54

MS. SPRAGUE: Okay. And when you worked downstairs, how often would you come upstairs during the day?

2691:43:01

PATRICK CLANCY: All the time. For lunch... or just to say hi.

2701:43:05

MS. SPRAGUE: Okay. Were there times when Lindsay would ask you to hold the baby in the office while she was doing something?

2711:43:15

PATRICK CLANCY: So, yeah.

2721:43:16

MS. SPRAGUE: Okay. And were there times when you would watch one, one or more of the children while she took another to a doctor's appointment or to an errand or something like that?

2731:43:26

PATRICK CLANCY: Yeah, if it worked out with the schedule, yeah.

2741:43:29
2751:43:34

MS. SPRAGUE: What was the plan in terms of how many shifts or hours she was going to work after Callan?

2761:43:42

PATRICK CLANCY: I believe the plan was two shifts per week. But there was a lot of flexibility. She could've done really anything.

2771:43:52

MS. SPRAGUE: Do you recall saying previously that you were gonna start off with one shift and hopefully move to two?

2781:43:59

PATRICK CLANCY: I could imagine, yeah.

2791:44:00

MS. SPRAGUE: Okay. And you said there was some options, correct? What were those options if that didn't work out?

2801:44:09

PATRICK CLANCY: Well, I always put money aside in basically our own maternity account, just so that if she needed more flexibility, we planned for that, so.

2811:44:20

MS. SPRAGUE: So if she needed more time off, more than what her work would provide for her, you were financially secure enough to afford that at this time?

2821:44:33
2831:44:33

MS. SPRAGUE: During this time, in the fall of 2022, were Cora and Dawson attending preschool?

2841:44:42
2851:44:42

MS. SPRAGUE: And where was that?

2861:44:44

PATRICK CLANCY: Learning Sprouts.

2871:44:45

MS. SPRAGUE: And where is Learning Sprouts located?

2881:44:47
2891:44:50

MS. SPRAGUE: How often were they attending Learning Sprouts?

2901:44:55

PATRICK CLANCY: Full days Monday, Wednesday, Friday, and a half-day on Thursday.

2911:44:59

MS. SPRAGUE: And what was a full day? How—what hours?

2921:45:02

PATRICK CLANCY: I think it was 9:00 to 4:00.

2931:45:04

MS. SPRAGUE: 9:00 AM to 4:00 PM?

2941:45:05

PATRICK CLANCY: I think so, yeah.

2951:45:06

MS. SPRAGUE: And what was a half day?

2961:45:08

PATRICK CLANCY: Like 9:00 to 12:30. I think they might have had some days where they started early. I can't remember.

2971:45:15

MS. SPRAGUE: But basically all day, you know, working hours all day Monday, Wednesday, Friday, and then the mornings on Thursday. Is that right?

2981:45:23
2991:45:28

MS. SPRAGUE: And who would do drop-offs for school?

3001:45:32

PATRICK CLANCY: We both would.

3011:45:33

MS. SPRAGUE: And what about pickups?

3021:45:35

PATRICK CLANCY: Both of us.

3031:45:36

MS. SPRAGUE: Together or take turns?

3041:45:38

PATRICK CLANCY: Usually we'd take turns.

3051:45:42

MS. SPRAGUE: Now, at some point in time, after Callan was born, did you hire a nanny?

3061:45:48
3071:45:49

MS. SPRAGUE: And when was that?

3081:45:52

PATRICK CLANCY: I think it was in August or September.

3091:45:58

MS. SPRAGUE: Of 2022?

3101:45:59
3111:46:00

MS. SPRAGUE: And who was that nanny?

3121:46:04

PATRICK CLANCY: Laney. I don't remember her last name.

3131:46:07

MS. SPRAGUE: Does Elaine Rossi sound familiar?

3141:46:09
3151:46:11

MS. SPRAGUE: And do you recall how many days per week Elaine was going to work when you hired her?

3161:46:21

PATRICK CLANCY: I think it was 12 hours.

3171:46:24

MS. SPRAGUE: But it wouldn't be 12 hours altogether. It would be spread out over the week. Is that right?

3181:46:27
3191:46:30

MS. SPRAGUE: And who was she hired to take care of?

3201:46:35

PATRICK CLANCY: Everyone. But mainly it was gonna be Callan.

3211:46:40

MS. SPRAGUE: Because Cora and Dawson would be at school?

3221:46:42

PATRICK CLANCY: For the most part, yeah.

3231:46:45

MS. SPRAGUE: And what was the plan for when Elaine would work? It was at that same type of—after Lindsay worked shifts or something different?

3241:46:56

PATRICK CLANCY: Yeah, the goal was after Lindsay would work sh— I mean, she never went back to work. But I think we wanted to get her just, like oriented with our house and the kids. So we had her start before and then she was amazing. She was an amazing caregiver. But eventually we decided to let her go because Lindsay was home anyways, so.

3251:47:27

MS. SPRAGUE: So when you initially hired her in August or September, you said Lindsay was going back to work in October. So is that what you're talking about, that give her that month or so, give Elaine that month or so to get situated and acclimated to the house?

3261:47:40
3271:47:41

MS. SPRAGUE: Okay. Have the kids get used to her. Is that right?

3281:47:43
3291:47:44

MS. SPRAGUE: Okay. Did she also, Elaine, did she also do some cleaning, laundry, and food prep?

3301:47:51

PATRICK CLANCY: Yeah. Yeah, she was amazing.

3311:47:55

MS. SPRAGUE: Now, during this time frame and again in the end of summer, fall period of 2022, what types of activities were Cora and Dawson doing?

3321:48:06

PATRICK CLANCY: Gymnastics.

3331:48:14

PATRICK CLANCY: Are you talking about organized activities or just in general?

3341:48:17

MS. SPRAGUE: Organized.

3351:48:19

PATRICK CLANCY: I only remember gymnastics.

3361:48:21

MS. SPRAGUE: Did they both do the gymnastics?

3371:48:22
3381:48:23

MS. SPRAGUE: And then were they also participating, maybe not in organized situations, but in swimming, soccer, skiing, things like that?

3391:48:29

PATRICK CLANCY: Yeah, they were doing swimming. And yeah, Cora and Dawson did skiing. Yeah, Cora started doing soccer. She didn't really like it, but did a little bit.

3401:48:38

MS. SPRAGUE: And who took them skiing?

3411:48:40
3421:48:41

MS. SPRAGUE: And as in terms of the swimming, where would you do that?

3431:48:46

PATRICK CLANCY: We did it at Goldfish in Rockland, I think. And then Lindsay took them somewhere in, I think, Plymouth. I don't, I don't remember where it was.

3441:48:58

MS. SPRAGUE: So you would each take them swimming at various times?

3451:49:01
3461:49:01

MS. SPRAGUE: Okay. And did you also do some swimming at the Kingsbury Club?

3471:49:06
3481:49:06

MS. SPRAGUE: And what is the Kingsbury Club?

3491:49:08

PATRICK CLANCY: It's like a gym with a pool. And they had childcare, so sometimes they would hang out in the kids' room, and we would go work out.

3501:49:18

MS. SPRAGUE: And is that in Duxbury?

3511:49:20

PATRICK CLANCY: It's on the Kingston/Duxbury line. I'm not entirely sure, but yeah.

3521:49:25

MS. SPRAGUE: Okay. And so you could drop the kids off at the daycare portion and go work out or swim or something like that?

3531:49:32

PATRICK CLANCY: Yeah, or we could go with them and go swimming.

3541:49:34

MS. SPRAGUE: Okay. Did Lindsay work out?

3551:49:38
3561:49:38

MS. SPRAGUE: She was very health conscious?

3571:49:40

PATRICK CLANCY: I think so.

3581:49:43

MS. SPRAGUE: And were you aware that she had been an athlete in both high school and college?

3591:49:47
3601:49:49

MS. SPRAGUE: Do you recall what she did?

3611:49:52

PATRICK CLANCY: Competitive cheerleading.

3621:49:55

MS. SPRAGUE: Now when you were together, what type of exercise would she do or did she prefer?

3631:50:01

PATRICK CLANCY: She did a lot of running. She did the Peloton. And she did—there was, like, some program called Beachbody, I think.

3641:50:10

MS. SPRAGUE: Do you recall when she started Beachbody?

3651:50:15

PATRICK CLANCY: Maybe in the spring of 2022. I'm not sure.

3661:50:18

MS. SPRAGUE: So right before having Callan. Would that be accurate?

3671:50:22

PATRICK CLANCY: Probably, yeah.

3681:50:32

MS. SPRAGUE: When you returned to work, and you said that was in August, correct?

3691:50:38
3701:50:39

MS. SPRAGUE: What was the defendant's demeanor when you returned to work?

3711:50:44

PATRICK CLANCY: Increased anxiety, and definitely, you know, stressed out.

3721:50:53

MS. SPRAGUE: Do you recall describing her as slightly stressed but in good spirits?

3731:50:58
3741:51:01

MS. SPRAGUE: And when she was stressed out, when she was showing some anxiety, how did that manifest?

3751:51:08

PATRICK CLANCY: I don't really know how to describe it. I guess it's just any way you can tell that somebody's stressed out. And, I don't know. She would say, you know, "I'm not looking forward to going back to work." I remember once she said, "It's just so unnatural to be separated from your newborn." You know, stuff like that.

3761:51:31

MS. SPRAGUE: So she didn't want to go back to work. Is that what you're saying?

3771:51:34

PATRICK CLANCY: I think she did. It was just a really difficult transition for her.

3781:51:42

MS. SPRAGUE: And do you recall attending a wedding on September 17th, 2022?

3791:51:48
3801:51:49

MS. SPRAGUE: And where was that wedding?

3811:51:50

PATRICK CLANCY: New Hampshire.

3821:51:52

MS. SPRAGUE: Was it just you and Lindsay that went, or did the whole family go?

3831:51:55

PATRICK CLANCY: We brought Callan.

3841:51:57

MS. SPRAGUE: And when you were at that wedding, do you recall having a conversation with Lindsay about medication?

3851:52:05
3861:52:06

MS. SPRAGUE: What did she say to you?

3871:52:08

PATRICK CLANCY: We were walking downtown, and she said, "I think I'm gonna start taking Zoloft."

3881:52:14

MS. SPRAGUE: And did she tell you why she wanted to start taking Zoloft?

3891:52:17

PATRICK CLANCY: She said, "I think it's really gonna help with my anxiety and with going back to work."

3901:52:22

MS. SPRAGUE: And did she tell you how she was going to go about getting Zoloft?

3911:52:28

PATRICK CLANCY: Yeah. I asked her, "How are you gonna get Zoloft? It's a prescription." And she said, "You know, usually you just ask the doctor and they'll give it to you."

3921:52:40

MS. SPRAGUE: And did she tell you that she was going to see a psychiatrist?

3931:52:45

PATRICK CLANCY: Yeah, I believe so.

3941:52:48

MS. SPRAGUE: And when she did that, did she tell you who she was going to see?

3961:52:55

MS. SPRAGUE: Did you eventually learn the name of the person who she went to see?

3971:52:59

PATRICK CLANCY: Months later, yeah.

3981:53:00

MS. SPRAGUE: Okay. And who was that?

3991:53:02

PATRICK CLANCY: Jennifer Tufts.

4001:53:04

MS. SPRAGUE: Okay. And do you... Did Lindsay tell you when she started seeing Dr. Jennifer Tufts?

4021:53:13

MS. SPRAGUE: Did you learn, or strike that. Did Lindsay tell you when she received the medication and when she started it?

4041:53:25

PATRICK CLANCY: I mean, I should correct that. It's not exactly—

4051:53:29

MS. SPRAGUE: Well, let me just ask the question first.

4061:53:31
4071:53:31

MS. SPRAGUE: When... Did you have a conversation with Lindsay about the medication she was on?

4081:53:38

PATRICK CLANCY: Eventually, yeah. But I didn't know the start date.

4091:53:41

MS. SPRAGUE: Okay. And so when did this conversation take place, this eventual conversation?

4101:53:48

PATRICK CLANCY: Probably the end of October.

4111:53:50

MS. SPRAGUE: Okay. And at that point, what did Lindsay tell you about the medication and how she was taking it?

4121:53:57

PATRICK CLANCY: I don't remember exactly, but I learned that she was taking the Zoloft. And...

4131:54:08

PATRICK CLANCY: I don't remember really too much about it after that. She was just taking it and, you know, we were seeing how it went.

4141:54:16

MS. SPRAGUE: And did you notice any changes in her physically during that timeframe that she was on it and you weren't aware she was on it?

4151:54:28

PATRICK CLANCY: At the time, no, I don't think I did.

4161:54:31

MS. SPRAGUE: And did you notice any changes in her emotionally during that time when she was on it but you weren't aware she was on it?

4171:54:40

PATRICK CLANCY: Yeah. She wasn't really improving. She just kinda seemed to be gradually becoming more, more in, like, a depressed state.

4181:54:51

MS. SPRAGUE: And how was that manifesting? What were you noticing?

4191:54:55

PATRICK CLANCY: It was just small things. I was planning a trip with Cora to San Francisco, and she was nervous about us going. And I remember we went to a Halloween event, and just leading up to it, I remember she was... It just kinda seemed like she didn't wanna go for some reason.

4201:55:17

MS. SPRAGUE: Okay. Now, do you recall learning that she had actually obtained the prescription the day before she told you she was going to ask for the prescription?

4211:55:31

PATRICK CLANCY: I did later learn that, yeah.

4221:55:32

MS. SPRAGUE: Okay. So she's telling you at the wedding that she is going to ask to take this medication and gonna see a psychiatrist to get on that medication. But she actually already had the prescription. Is that correct?

4231:55:43

PATRICK CLANCY: Correct. I don't think she started taking it yet, but she already had it.

4241:55:46
4251:55:54

MS. SPRAGUE: And did Lindsay tell you how long she took the medication for?

4261:56:04

PATRICK CLANCY: She may have. I don't remember the exact timeframe. I just remember she took it for a period of time, and then her sleep started to suffer, so she stopped taking it.

4271:56:16

MS. SPRAGUE: And did she tell you whether or not she spoke to her provider, her doctor, about the troubles she was having?

4281:56:26

PATRICK CLANCY: I believe so, yeah.

4291:56:27

MS. SPRAGUE: Okay. And did Lindsay tell you that she was advised to double the dose of the Zoloft?

4301:56:37

PATRICK CLANCY: She may have. I don't remember.

4311:56:41

MS. SPRAGUE: Page 31. May I approach? If you could look at lines 20 to 22, and then just look up when you're finished.

4321:56:51

PATRICK CLANCY: Sure. Okay. Yeah, apparently she did.

4331:56:57

MS. SPRAGUE: Does that refresh it for you?

4341:56:59
4351:57:00

MS. SPRAGUE: And so did Lindsay tell you that she was supposed to double the dose?

4361:57:05

PATRICK CLANCY: I guess she did, yeah.

4371:57:20

MS. SPRAGUE: Did you notice any changes in her sleep during that time when she was on the medication but you weren't aware she was on it?

4381:57:28

PATRICK CLANCY: Eventually, yeah.

4391:57:30

MS. SPRAGUE: When was that?

4401:57:32

PATRICK CLANCY: I don't remember the exact dates. But she just, you know, one night she said, “Do you mind...” She started by saying, “I'm not mad or anything, but do you mind sleeping in the basement, and letting me just sleep in our room with Callan? And then you can take the monitors down in the basement, and if Cora and Dawson get up, you can get up with them.” She said, “I'd... I've just been having a lot of trouble sleeping. And I'm hoping that, like, if there's less in and out, then there'll be less disruption.”

4411:58:07

MS. SPRAGUE: Okay. Had you noticed prior to her telling you this that she was up a lot or having trouble sleeping, like physically seeing her awake?

4421:58:15

PATRICK CLANCY: No, not that I recall.

4431:58:17

MS. SPRAGUE: And did you in fact start sleeping in the basement for a period of time?

4441:58:20

PATRICK CLANCY: I think I did it for, like, two nights, and then she actually went down in the basement.

4451:58:24

MS. SPRAGUE: Okay. So then you went back up to your bedroom to sleep. Is that correct?

4461:58:27
4471:58:28

MS. SPRAGUE: And how long did Lindsay sleep in the basement for after that?

4481:58:33

PATRICK CLANCY: Maybe a couple weeks.

4491:58:35

MS. SPRAGUE: And so during that timeframe, was she telling you that she was still having trouble sleeping?

4501:58:40
4511:58:41

MS. SPRAGUE: But you weren't actually down there watching her sleep. You're getting this information from her, correct?

4521:58:46
4531:58:54

MS. SPRAGUE: Were you aware that out of the Zoloft prescription she was given, she only took seven pills?

4551:59:08

MS. SPRAGUE: After you had the conversation with Lindsay where she said she was going to double the dose of Zoloft, did you notice any difference in her demeanor or behavior?

4561:59:19

PATRICK CLANCY: I would say yes. I don't know if I connected it with the doubling of her Zoloft, but over that period of time, she always—she just kept getting worse and worse.

4571:59:31

MS. SPRAGUE: And what period of time was that? What month are we in?

4581:59:35

PATRICK CLANCY: Mid-October to the end of December.

4591:59:37

MS. SPRAGUE: Okay. So she got the prescription in September, started taking it in October, took seven pills, but was having difficulty in December. Is that what you're saying?

4601:59:49
4611:59:49

MS. SPRAGUE: From this medication.

4621:59:50

PATRICK CLANCY: Yep. Well, I don't know which medication it's from, but yeah.

4631:59:54
4641:59:57

MS. SPRAGUE: At some point in time, did she, Lindsay, switch providers?

4652:00:01
4662:00:02

MS. SPRAGUE: And why did she do that?

4672:00:05

PATRICK CLANCY: Because the—whatever she was doing with Jennifer Tufts, it wasn't working. She was just—she was only getting worse. And she thought that it would be better if she worked with, I guess, more of like a perinatal psychiatrist.

4682:00:24

MS. SPRAGUE: And did she get a referral or a recommendation of where to go?

4692:00:27

PATRICK CLANCY: I think so, yeah.

4702:00:28

MS. SPRAGUE: Do you know who gave her that recommendation?

4712:00:31

PATRICK CLANCY: It might have been my mother.

4722:00:33

MS. SPRAGUE: And your mother's a nurse at South Shore Hospital, correct?

4732:00:35
4742:00:36

MS. SPRAGUE: Does she also do labor and delivery work?

4752:00:38
4762:00:38

MS. SPRAGUE: Okay. And so, do you know which provider or which office she recommended?

4772:00:46

PATRICK CLANCY: Yeah. Her name is Julie Paul.

4782:00:49

MS. SPRAGUE: And was she at the South Shore Perinatal Clinic?

4792:00:52

PATRICK CLANCY: Something like that, yeah.

4802:00:53

MS. SPRAGUE: Okay. And do you know when that was?

4812:00:57

PATRICK CLANCY: I don't know the dates on that.

4822:01:04

MS. SPRAGUE: Do you recall saying previously that it was towards the end of November?

4832:01:09

PATRICK CLANCY: Yeah, that sounds accurate, yeah.

4842:01:12
4852:01:16

MS. SPRAGUE: And you said she initially saw someone named Julie Paul, is that correct?

4862:01:19
4872:01:20

MS. SPRAGUE: Okay. And do you know how long she saw Julie Paul at that facility?

4882:01:27

PATRICK CLANCY: I think it was only four or five days.

4892:01:30

MS. SPRAGUE: And were you aware that Julie Paul left that office?

4902:01:34
4912:01:35

MS. SPRAGUE: And do you know who Lindsay saw after Julie Paul?

4922:01:39

PATRICK CLANCY: Rebecca Jollotta.

4932:01:41

MS. SPRAGUE: And was Rebecca Jollotta a nurse practitioner?

4942:01:44
4952:01:46

MS. SPRAGUE: Okay. Were you aware that she also saw a licensed social worker/therapist named Latiesha Dukes while she was at the South Shore Perinatal Clinic?

4962:01:58

PATRICK CLANCY: I don't recall Latiesha Dukes, but it's possible.

4972:02:03

MS. SPRAGUE: So Lindsay never told you that she had therapy sessions with a person named Latiesha Dukes during that timeframe?

4982:02:09

PATRICK CLANCY: I don't remember any therapy sessions, no.

4992:02:11
5002:02:16

MS. SPRAGUE: After switching to Julie Paul and then Rebecca Jollotta, did Lindsay start coming home with different prescription bottles?

5012:02:27
5022:02:28

MS. SPRAGUE: Okay. And were some of these medications that she came home with, were the, some of them during the time she was with Dr. Tufts?

5032:02:39

PATRICK CLANCY: I think some of them were, yep.

5042:02:40

MS. SPRAGUE: And some of them were while she was with Julie Paul, is that correct?

5052:02:44
5062:02:45

MS. SPRAGUE: And then some while she was with Nurse Practitioner Jollotta. Is that correct?

5072:02:50
5082:02:50

MS. SPRAGUE: Okay. And would it be accurate to state that you provided the district attorney's office with a printout from CVS Pharmacy of all the prescriptions that were filled for Lindsay from September through January. September, 2022 through January of 2023?

5092:03:21
5102:03:25

THE COURT: Any objection?

5112:03:26

MR. REDDINGTON: No, of course not.

5122:03:27

MS. SPRAGUE: I'd ask that to be entered as Exhibit 1.

5132:03:28

THE COURT: Sure. Yeah.

5142:03:33

THE COURT: And members of the jury, one of the things I forgot to tell you is anything that's entered as an exhibit, you'll have with you in the deliberating room when you're deliberating. So you'll have a chance to go over that as well. So you'll have anything that's marked as an exhibit. Okay.

5152:03:49

COURT REPORTER: Exhibit 1 is so marked.

5162:03:50

THE COURT: Thank you.

5172:03:55

MS. SPRAGUE: Now, while she was taking these medications, the various pills, were you always with her, watching and monitoring exactly what she took?

5182:04:04

PATRICK CLANCY: Not always, no.

5192:04:05

MS. SPRAGUE: Sometimes you'd see it, sometimes you wouldn't?

5202:04:08
5212:04:11

MS. SPRAGUE: Directing your attention to February 6, 2023. Did you go to the district attorney's office and, or have your attorney go there and provide a bag of prescription medication that had belonged to Lindsay?

5222:04:26

PATRICK CLANCY: Yeah. I think the police took a bag of prescription medications that night, the night my kids passed away.

5232:04:36

MS. SPRAGUE: Mm-hmm.

5242:04:36

PATRICK CLANCY: And then there was a bag that I had in my truck that I was supposed to— Nurse Practitioner Jollotta said, "You can bring them to, like, a police station and they get rid of them for you." But I never got around to it.

5252:04:55

MS. SPRAGUE: And where had you stored those in your truck?

5262:04:58

PATRICK CLANCY: In the center console. It's, like, underneath the center console that opens.

5272:05:05

MS. SPRAGUE: You have one of those center consoles that open up, but then there's another larger con-

5282:05:08
5292:05:08

MS. SPRAGUE: ... compartment below it?

5302:05:09
5312:05:10

MS. SPRAGUE: So was it your plan to bring these to a location where they could be properly disposed?

5322:05:16

PATRICK CLANCY: Yeah, I didn't wanna just throw them in the trash, so.

5332:05:19

MS. SPRAGUE: And these were all medications that had been prescribed in the past to Lindsay, but she was no longer taking, correct?

5342:05:26
5352:05:35

MR. REDDINGTON: Your Honor, I don't think I have any objection to any of their exhibits.

5362:05:38
5372:05:38

MR. REDDINGTON: So I don't... She doesn't have to keep showing it to me. That's fine.

5382:05:41

THE COURT: All right. So I'll assume if you do have an objection, just—

5392:05:43
5402:05:44

THE COURT: ... Rise, let me know. Okay. Thank you.

5412:05:47

MS. SPRAGUE: So for the record, a bag here with nine pill bottles as Exhibit 2, please.

5422:05:58

COURT REPORTER: It's been marked.

5432:05:59

THE COURT: Thank you.

5442:06:09

MS. SPRAGUE: And so looking in Exhibit 2, we have the Zoloft that was prescribed by Dr. Tufts and filled on September 15th, 2022. And I think we— I asked you earlier, you weren't aware that only seven pills were taken out of this, correct?

5452:06:28

PATRICK CLANCY: That's correct.

5462:06:29

MS. SPRAGUE: Okay. And then there's another prescription in here for Ativan that was filled on October 26th, 2022. Were you aware that only six pills were taken out of that bottle?

5472:06:43

PATRICK CLANCY: Can you say the date again?

5482:06:45

MS. SPRAGUE: October 26th, 2022.

5492:06:48

PATRICK CLANCY: And how many did it start with?

5502:06:50

MS. SPRAGUE: Let's see.

5512:07:15

MS. SPRAGUE: 30 pills.

5522:07:17

PATRICK CLANCY: Okay. I mean, I don't have those exact numbers on how many she took. But there was, there were adjustments made on the dosage of the Ativan.

5532:07:28

MS. SPRAGUE: Mm-hmm.

5542:07:29

PATRICK CLANCY: So that aligns with that.

5552:07:31

MS. SPRAGUE: But the question was, were you aware that only six pills were taken out of this prescription?

5562:07:37

PATRICK CLANCY: No, but I think the context is important.

5572:07:41

MS. SPRAGUE: Okay. Were you aware that there was a prescription for buspirone, or Buspar, filled on October 26th, 2022, in which only two pills were taken out of the 30 that were prescribed?

5582:07:57

PATRICK CLANCY: I found out about the Buspar later, and I didn't know about the number of pills taken.

5592:08:04

MS. SPRAGUE: And then were you aware that there was a prescription for hydroxyzine, a prescription filled on October 26th, 2022? For 30 pills in that, only three pills were taken out of this bottle.

5602:08:19

PATRICK CLANCY: Which, uh—

5612:08:21

MS. SPRAGUE: Hydroxyzine.

5622:08:21

PATRICK CLANCY: Yeah, what is that?

5632:08:23

MS. SPRAGUE: I believe it's some type of similar to an antihistamine, like Benadryl or something like that.

5642:08:29

PATRICK CLANCY: Oh, okay. I don't really recall much about that drug.

5652:08:34

MS. SPRAGUE: Okay. And...

5662:08:41

MS. SPRAGUE: Were you aware in this bag there was another prescription for Buspar that was filled on November 9th, 2022, 30 pills prescribed, and no pills were taken out of this bottle? Were you aware of that?

5672:08:59

PATRICK CLANCY: I wasn't keeping track of the number of pills taken out of each bottle, so...

5682:09:05

MS. SPRAGUE: Okay. And then, just ask you about one more. The Trazodone.

5692:09:10
5702:09:11

MS. SPRAGUE: Prescribed on November 16th, 2022, by a doctor from South Shore Hospital. 30 pills. Were you aware that only seven and a half pills were taken out of this prescription?

5722:09:26

MS. SPRAGUE: So there were a lot of pills prescribed, but not a lot of pills taken, correct?

5732:09:33

PATRICK CLANCY: Is that comprehensive of all the pills that were prescribed?

5742:09:36

MS. SPRAGUE: These are the pills that you brought into the police station. So out of these.

5752:09:40

PATRICK CLANCY: Out of those, yeah, it's possible that not a lot were taken.

5762:09:59

MS. SPRAGUE: Do you recall what was the most amount of pills prescribed... That's, I guess I could ask this better. What was the maximum number of medications she was on at any one time?

5772:10:16

PATRICK CLANCY: I wanna say three or four.

5782:10:18
5792:10:22

MS. SPRAGUE: Would it surprise you to know that she, at any given time, the most she was prescribed was three, but most of the time it was two medications that she was prescribed at any given time?

5802:10:35

PATRICK CLANCY: It wouldn't be terribly surprising, no.

5812:10:38

MS. SPRAGUE: Now, on November 16th, 2022, did Lindsay visit South Shore Hospital?

5822:10:46
5832:10:47

MS. SPRAGUE: Okay. And why did she go to the South Shore Hospital that day?

5842:10:54

PATRICK CLANCY: I believe that day it was because she basically went 48 hours without sleeping.

5852:10:59

MS. SPRAGUE: And was she having heart palpitations?

5862:11:03

PATRICK CLANCY: I think so, yeah.

5872:11:05

MS. SPRAGUE: Were you aware that she had taken a weed gummy that day?

5882:11:10

PATRICK CLANCY: I don't recall.

5892:11:14

MS. SPRAGUE: And are you aware that she didn't tell medical staff at the hospital, when describing her symptoms and her medication, that she left out that she had used marijuana?

5902:11:25

PATRICK CLANCY: I wasn't with her, so I don't know what she talked about at the hospital.

5912:11:29

MS. SPRAGUE: So she drove herself to the hospital?

5922:11:30
5932:11:32

MS. SPRAGUE: Okay. And she drove herself home from the hospital then, is that correct?

5942:11:40
5952:11:40

MS. SPRAGUE: Now, during this timeframe between September and November of 2022, are you still participating in activities as a family?

5962:11:50

PATRICK CLANCY: Between November and December?

5972:11:51

MS. SPRAGUE: Between September and November.

5982:11:53
5992:11:54

MS. SPRAGUE: Okay. And what types of things were you doing?

6002:11:59

PATRICK CLANCY: We celebrated Halloween.

6012:12:06

PATRICK CLANCY: I don't really remember what else, but I think we were doing things regularly.

6022:12:14

MS. SPRAGUE: Do you recall going to an event with food trucks?

6032:12:26
6042:12:27

MS. SPRAGUE: And do you recall going to an event in November where there were trains to ride with the kids?

6052:12:35
6062:12:40

MS. SPRAGUE: So if we have, the photo from the food truck event is in Exhibit three.

6072:12:50

MS. SPRAGUE: And the photo from the train event is in Exhibit four.

6082:12:54

COURT REPORTER: Three and four, so marked.

6092:12:57

MS. SPRAGUE: If I may publish?

6102:12:58

THE COURT: You may.

6112:13:05

MS. SPRAGUE: So Exhibit three is this, Lindsay, Cora, and Callan at that event?

6122:13:11
6132:13:12

MS. SPRAGUE: And Exhibit four is just Lindsay with all three kids at that event in November?

6142:13:18
6152:13:31

MS. SPRAGUE: Did you have plans for Thanksgiving that year?

6162:13:34
6172:13:35

MS. SPRAGUE: What were your plans?

6182:13:37

PATRICK CLANCY: I believe the order was we went to Wallingford, where her parents lived, in the week before, and then the week after, we went to my sister's house.

6192:13:50

MS. SPRAGUE: And where did your sister live? What town?

6202:13:54

PATRICK CLANCY: South Hamilton.

6212:13:55

MS. SPRAGUE: And that was a week after Thanksgiving, is that correct?

6222:14:00

PATRICK CLANCY: I think so, yeah. Yeah, it was.

6232:14:08

MS. SPRAGUE: And is this a photo from Thanksgiving at your sister's house?

6242:14:14
6252:14:16

MS. SPRAGUE: I could have this photo marked as Exhibit five, I believe.

6262:14:19

THE COURT: All right, that may be marked.

6272:14:29

MS. SPRAGUE: Showing you what's been marked Exhibit five. Is this Lindsay here on the left?

6282:14:36
6292:14:37

MS. SPRAGUE: And are those your sisters in the photo with her?

6302:14:40

PATRICK CLANCY: That's one of my sisters and my sister-in-law.

6312:14:43

MS. SPRAGUE: Okay. And have they coordinated outfits for the day, the shirts?

6322:14:48

PATRICK CLANCY: Yeah, I think my sister did.

6332:14:54

MS. SPRAGUE: What was Lindsay's demeanor that day?

6342:14:59

PATRICK CLANCY: She was in rough shape.

6352:15:01

MS. SPRAGUE: Rough shape?

6362:15:02
6372:15:02

MS. SPRAGUE: How so?

6382:15:03

PATRICK CLANCY: She wasn't talking much. She had low energy. She was really depressed. I just remember when she showed up, my sister-in-law gave her a big hug.

6392:15:13

MS. SPRAGUE: And she was able to get through dinner, eat dinner with everyone?

6402:15:18
6412:15:18

MS. SPRAGUE: Okay. She interacted with people, is that correct?

6422:15:23

PATRICK CLANCY: I would say very little, but to some degree, sure.

6432:15:26

MS. SPRAGUE: And she took care of the kids with you while she was there?

6442:15:30

PATRICK CLANCY: We both took care of the kids together.

6452:15:37

MS. SPRAGUE: Okay. You mentioned earlier that your wedding anniversary is in December. Is that correct?

6462:15:41
6472:15:42

MS. SPRAGUE: Okay. Do you recall going out for your anniversary on December 3rd, 2022, going into Boston?

6482:15:50

PATRICK CLANCY: No. We didn't go out.

6492:15:52

MS. SPRAGUE: You don't recall arranging for a massage for Lindsay, and then going to the Omni Parker House, and going out to dinner that night?

6502:16:02

PATRICK CLANCY: No. December 3rd, 2022, we stayed home.

6512:16:04

MS. SPRAGUE: You stayed home. Okay.

6522:16:29

MS. SPRAGUE: Showing you a photo of you and Lindsay. Do you recognize this photo?

6532:16:35
6542:16:36

MS. SPRAGUE: And when was that taken?

6552:16:39

PATRICK CLANCY: I'm not really sure.

6562:16:42

MS. SPRAGUE: It wasn't taken on December 3rd when you were out celebrating your anniversary?

6572:16:45
6582:16:47
6602:16:52

PATRICK CLANCY: No, we wanted to go out.

6612:16:54

MS. SPRAGUE: Mm-hmm.

6622:16:54

PATRICK CLANCY: But we canceled because she wasn't feeling well, so we stayed home. We got takeout.

6632:16:58
6642:17:03

MS. SPRAGUE: Did you also, on November 26th, 2022, go out as a family to get a Christmas tree?

6652:17:13

PATRICK CLANCY: Yes. Well, probably. I don't know. But yeah, around that time, yes.

6662:17:18
6672:17:26

MS. SPRAGUE: Showing you two photos. Are these from that day when you got the Christmas tree?

6682:17:32

PATRICK CLANCY: Yeah, that looks accurate.

6692:17:38

MS. SPRAGUE: If we could have the first photo of all five, it's Exhibit

6702:17:45

MS. SPRAGUE: Six. And then the second one is Exhibit seven.

6712:17:55

MS. SPRAGUE: Exhibit seven.

6722:18:02

MS. SPRAGUE: Showing you exhibit six.

6732:18:08

MS. SPRAGUE: This is all of you at the tree farm?

6742:18:10
6752:18:12

MS. SPRAGUE: And exhibit seven, those are the kids?

6762:18:16
6772:18:28

MS. SPRAGUE: Around December 6th, 2022, did Lindsay tell you she was starting a new medication?

6782:18:38

PATRICK CLANCY: I don't remember specifically.

6792:18:42

MS. SPRAGUE: Is it that you don't remember the date, or you don't remember her starting a new medication?

6802:18:48

PATRICK CLANCY: I'm not sure.

6812:18:49

MS. SPRAGUE: Do you remember Lindsay telling you at some point she was starting the medication Seroquel?

6822:18:55
6832:18:55

MS. SPRAGUE: Do you remember around what timeframe that was?

6842:18:59

PATRICK CLANCY: I thought it was before December 6th.

6852:19:02
6862:19:07

MS. SPRAGUE: And do you recall—

6872:19:13

MS. SPRAGUE: How she was physically after starting the Seroquel?

6882:19:19
6892:19:20

MS. SPRAGUE: How so?

6902:19:22

PATRICK CLANCY: That was really where her big spiral started. She started to lose a lot of weight, and she became very depressed, and she was having a really hard time.

6912:19:35

MS. SPRAGUE: Okay. And did she describe to you some thoughts or feelings that she was having at that time?

6922:19:44

PATRICK CLANCY: Yeah. She started to say she was suicidal.

6932:19:47

MS. SPRAGUE: And was that in December of 2022?

6942:19:50

PATRICK CLANCY: I think so, yeah.

6952:19:52

MS. SPRAGUE: Okay. And when she told you she was suicidal, did you ask her if she had a plan on how to kill herself?

6962:19:58
6972:19:59

MS. SPRAGUE: And what was her response?

6982:20:02

PATRICK CLANCY: She said no.

6992:20:03

MS. SPRAGUE: Okay. And did she ever mention a specific way or plan she had to kill herself to you?

7012:20:13

MS. SPRAGUE: And at some point in time, did she tell you that this was the first time she had had suicidal thoughts?

7022:20:25

PATRICK CLANCY: I don't know if she mentioned it was the first time or not. I just remember her saying she had them.

7032:20:30

MS. SPRAGUE: Had you ever heard her say that to you before, that she was having suicidal thoughts?

7052:20:36

MS. SPRAGUE: Did you own at that time a Surface Pro, a type of tablet that works as a laptop?

7062:20:44
7072:20:45

MS. SPRAGUE: And who had access to that laptop?

7082:20:48

PATRICK CLANCY: We both did.

7092:20:49

MS. SPRAGUE: Okay. You and Lindsay?

7102:20:50
7112:20:51

MS. SPRAGUE: And going back to August 22nd, 2022, did you click on a link on that Surface Pro that was titled 'Methods of Suicide'?

7122:21:01

PATRICK CLANCY: Not that I recall.

7132:21:04

MS. SPRAGUE: Okay. And August 22nd, 2022, that was before Lindsay had been on any medications as far as you know, correct?

7142:21:11
7152:21:17

MS. SPRAGUE: Going back to December, she's told you that she's having these thoughts. What's your reaction when she tells you that she's having these suicidal thoughts?

7162:21:31

PATRICK CLANCY: I just wanted to support her. I asked those questions back to her. And, you know, her mother was coming up pretty regularly anyways, so we let them know. And we just tried to be supportive.

7172:21:48

MS. SPRAGUE: Did she also tell you at that time at the beginning of December that she was having some other intrusive thoughts?

7182:21:55
7192:21:55

MS. SPRAGUE: Is that how she described them or how you described them, intrusive thoughts?

7202:22:00

PATRICK CLANCY: I would say both.

7212:22:01

MS. SPRAGUE: Okay. And when she told you that she was having intrusive thoughts, did you ask her what they were?

7222:22:08
7232:22:09

MS. SPRAGUE: And what was her response?

7242:22:11

PATRICK CLANCY: She described thoughts of hurting the kids or having—or them having some sort of ailment. So, like, she was very worried that Cora had... Whenever she had a stomachache, she became overly worried that she was, you know, like, had, like, a liver problem or something much more dramatic than it was.

7252:22:34

MS. SPRAGUE: Okay. But going back to that first part, she said she had thoughts of harming the kids. Is that correct?

7262:22:39
7272:22:40

MS. SPRAGUE: And did she tell you whether or not she had specific thoughts of how she would harm the kids?

7292:22:48

MS. SPRAGUE: And she didn't describe that as hearing this external voice telling her to harm the kids, correct?

7302:22:54
7312:22:54

MS. SPRAGUE: She told you she was having intrusive thoughts herself of harming the children, correct?

7322:23:02
7332:23:03

MS. SPRAGUE: And did you ask her how she was going to harm the kids?

7342:23:09

PATRICK CLANCY: I didn't ask it in that way. It was the same thing. I said, "Do you have a plan?" And, "Is it disturbing to you?" And she said no. And then she said yes. And, um—

7352:23:19

MS. SPRAGUE: Let me go back for a minute there. You said, "Do you have a plan?" And she said no. What was the second question, second part of the question?

7362:23:27

PATRICK CLANCY: Is it, "Do you find it disturbing?" And she said yes. And she described it as... Really, the way she was describing it as something that might happen to the kids.

7372:23:38

MS. SPRAGUE: It was more something might happen than she might do something. Is that correct?

7382:23:43
7392:23:44

MS. SPRAGUE: And did she tell you how long she had those thoughts for?

7402:23:52

PATRICK CLANCY: She didn't give a duration.

7412:23:54

MS. SPRAGUE: And how many times did she tell you this, that she had thoughts of harming the kids?

7422:24:03

PATRICK CLANCY: Couple times.

7432:24:04

MS. SPRAGUE: And was that a couple times over the course of a night or two in December?

7442:24:08
7452:24:09

MS. SPRAGUE: Okay. And as a result of her telling you this, that she had thoughts of harming the kids, what did you do?

7462:24:17

PATRICK CLANCY: Her parents came up. And I think I asked her at some point, you know, "Do you feel like you need to be kept away from them?" And she said no. And then, you know, it was very confusing because a minute later she was making them lunch or playing with them or, you know, getting them ready for bed or whatever it was, so...

7472:24:37

MS. SPRAGUE: So it was confusing in that she wasn't physically harming them at the time but had had these thoughts. Is that what you're saying?

7482:24:46

PATRICK CLANCY: Right. I never saw Lindsay harm the kids.

7492:24:50

MS. SPRAGUE: And did you also, as a result of these statements, suggest an appointment with nurse practitioner, Jollotta?

7502:24:59

PATRICK CLANCY: It wasn't as a result of these statements. That appointment was set up because we were at her parents' house in Wallingford for Thanksgiving. And she just described how she was feeling on the medication. And she felt that she was addicted to them.

7512:25:22

MS. SPRAGUE: Was that the benzodiazepines that she thought she was addicted to?

7522:25:25

PATRICK CLANCY: Primarily. And then she was taking Seroquel at the same time. And she might have been taking Trazodone or Remeron. I'm not sure.

7532:25:34

MS. SPRAGUE: Okay. Do you recall testifying previously that, "I called her parents to come up to stay with us, and I told her that we needed—I asked her who her doctor was because I was very concerned at this point. She was prescribed 10 different medications in just over two months, so it didn't make sense to me." And then you said, "So after her parents came up, she has—she said, 'I have a remote meeting with Rebecca Jollotta.'" And you said, "No, it has to be in person."

7542:25:59

PATRICK CLANCY: Yeah, I felt like it had to be in person because I just felt like there was a disconnect. I felt like we could figure it out, whatever was going on.

7552:26:10

MS. SPRAGUE: Mm-hmm.

7562:26:10

PATRICK CLANCY: So, it seemed like most of her telehealth appointments were pretty quick. And there just wasn't, like, a lot of attention. And—

7572:26:21

MS. SPRAGUE: Were you present for these telehealth visits?

7582:26:24

PATRICK CLANCY: Only a few of them.

7592:26:25
7602:26:25

PATRICK CLANCY: And they were after that meeting with Jollotta.

7612:26:27

MS. SPRAGUE: Okay. And that appointment in person with Jollotta was December 6th, 2022. Is that correct?

7622:26:32

PATRICK CLANCY: That sounds correct.

7632:26:37

MS. SPRAGUE: So the thought of harming the kids was after Thanksgiving, but before December 6th. Is that correct?

7642:26:43

PATRICK CLANCY: That sounds correct.

7652:26:47

MS. SPRAGUE: Okay. Were you concerned for the kids' safety at that time?

7662:26:50

PATRICK CLANCY: No, I wasn't.

7672:26:51

MS. SPRAGUE: And why not?

7682:26:53

PATRICK CLANCY: Because she wasn't showing any intention of harming the kids.

7692:26:57

MS. SPRAGUE: And she told you she didn't have a plan, is that correct?

7702:26:59
7712:27:08

MS. SPRAGUE: Now, directing your attention to December 15th, 2022, did Lindsay go to Mass General Hospital to the emergency department that day?

7722:27:22
7732:27:23

MS. SPRAGUE: Okay. And why was that?

7742:27:25

PATRICK CLANCY: I remember the reasoning being she told her dad that she wanted to commit suicide, and then she said to me, "I told my dad I want to die," and it didn't bother me at all.

7752:27:40
7762:27:52

MS. SPRAGUE: As a result of those statements, you brought her or did she bring herself to Mass General?

7772:27:58

PATRICK CLANCY: I think I brought her that time.

7782:28:00

MS. SPRAGUE: And at Mass General she saw medical staff, correct?

7792:28:05
7802:28:06

MS. SPRAGUE: Okay. And did they recommend to her some type of admission to McLean Hospital?

7812:28:16

PATRICK CLANCY: I remember there was one doctor who was in favor of that, and there were two others who were more in favor of a day program.

7822:28:23

MS. SPRAGUE: Okay. And did they give you information about a specific day program?

7832:28:27

PATRICK CLANCY: Yeah, it was Women and Infants in Providence.

7842:28:31

MS. SPRAGUE: And at that time when Lindsay was saying that she was suicidal, was she asked if she had a plan?

7852:28:40

PATRICK CLANCY: By the doctors?

7862:28:41

MS. SPRAGUE: Or by you.

7872:28:42

PATRICK CLANCY: I was always checking in with her and she never told me that she had a plan. I'm not sure what the doctors asked her.

7882:28:49
7892:28:53

MS. SPRAGUE: And after being at Mass General on December 15th, did she go to Women and Infants Hospital in Rhode Island—

7902:29:03
7912:29:03

MS. SPRAGUE: … to attempt to get into their postpartum program?

7922:29:07

PATRICK CLANCY: She was already in. She went and, as scheduled.

7932:29:10

MS. SPRAGUE: Okay. And but she didn't remain in, correct? She was just there for a day.

7942:29:15
7952:29:15

MS. SPRAGUE: Okay. And did she go by herself? Did you go with her?

7962:29:21

PATRICK CLANCY: I dropped her off, and then I took Dawson skiing.

7972:29:23

MS. SPRAGUE: Okay. And at some point in time, did Lindsay reach out to you to say she wasn't staying at the program and to come pick her up?

7982:29:32

PATRICK CLANCY: She actually said that the providers at that program suggested to her that she call me and have her come get picked up, and then that I should go in and meet with the providers.

7992:29:44

MS. SPRAGUE: Okay. And then after you picked her up, you didn't… She was no longer in the program at that point, correct? At Rhode Island Women and Children's, right?

8002:29:56

PATRICK CLANCY: Well, we discussed it with the doctors and their recommendation was that the program wasn't right for her.

8012:30:01

MS. SPRAGUE: Right. And so you guys returned home, is that correct?

8022:30:05
8032:30:06

MS. SPRAGUE: Okay. And during this timeframe, in December, Lindsay's still working out at the Kingsbury Club, correct?

8042:30:23

PATRICK CLANCY: That might be true. I don't recall exactly, but yeah.

8052:30:33

MS. SPRAGUE: Okay. Do you recall her going to the Kingsbury Club on December 6th, 13th, 16th, 17th, or 18th?

8062:30:41

PATRICK CLANCY: I mean, I believe that can be true, yeah. I don't recall those exact dates, but yeah.

8072:30:47

MS. SPRAGUE: At this time when she's saying that she's feeling suicidal, she's telling you she doesn't have a plan, correct?

8082:31:00
8092:31:01

MS. SPRAGUE: She's no longer saying she has any thoughts of harming the children, correct?

8102:31:05
8112:31:06

MS. SPRAGUE: Okay. She's still bringing the children to doctor's appointments during that time, right?

8122:31:13
8132:31:14

MS. SPRAGUE: Do you recall her bringing Callan and Dawson to the doctor's on December 2nd when they weren't feeling well?

8142:31:22
8152:31:24

MS. SPRAGUE: And then she was able to call the doctor's office on December 27th and make an appointment for Callan and Cora when they weren't feeling well. Do you remember that?

8162:31:33
8172:31:34

MS. SPRAGUE: And take them to the doctor, I believe with you, correct?

8182:31:39

PATRICK CLANCY: Maybe. I don't know.

8192:31:44

MS. SPRAGUE: And then on December 30th, she was able to take Callan to the doctor that day as well and interact with the staff. Is that correct?

8202:31:53

PATRICK CLANCY: Probably.

8212:31:57

MS. SPRAGUE: Then you returned to Mass General Hospital, the emergency department, on December 31st. Is that correct?

8222:32:05
8232:32:06

MS. SPRAGUE: And why did you go back on the 31st?

8242:32:09

PATRICK CLANCY: Because she was still talking about thoughts of suicide. And I was exhausted. I said, "I think it's time to go to McLean." And we didn't have a diagnosis, so we just didn't really know what was wrong. And I think for me, I was hoping that McLean could really evaluate her and, you know, try to figure out the best path forward.

8252:32:38

MS. SPRAGUE: Okay. So the path to getting to McLean was to go to the emergency department at Mass General and be referred to McLean. Is that correct?

8262:32:44
8272:32:50

MS. SPRAGUE: Were you aware that that night, while at the hospital, Lindsay was taking selfies?

8292:33:13

MS. SPRAGUE: Producing these two photos as evidence.

8302:33:16

THE COURT: Right. That may be admitted. They may be admitted.

8312:33:27

MS. SPRAGUE: Showing you exhibit 8, is she taking a selfie at the hospital, is that correct?

8322:33:37

PATRICK CLANCY: Are you asking me?

8332:33:38
8342:33:39

PATRICK CLANCY: Yeah, I can see that, yeah.

8352:33:41

MS. SPRAGUE: And then the second page is just her legs in the doorway. Is that correct?

8362:33:58
8372:33:58

MS. SPRAGUE: As a result of going to Mass General and telling them about her suicidal thoughts, was she transferred to McLean Hospital?

8382:34:07
8392:34:07

MS. SPRAGUE: Okay. And did you stay with her throughout that transfer process, or were you able to?

8402:34:15

PATRICK CLANCY: I was not able to. They, for some reason, they transfer... I don't know if they do this with all patients, but she was transferred at 3:00 in the morning.

8412:34:23

MS. SPRAGUE: Okay. And so she reached McLean in the early morning hours of January 1st then, of 2023. Is that correct?

8422:34:32
8432:34:33

MS. SPRAGUE: Okay. And did you visit her at McLean Hospital?

8442:34:36
8452:34:36

MS. SPRAGUE: How often did you see her there?

8462:34:39

PATRICK CLANCY: I think I was able to go twice, or maybe three times.

8472:34:42

MS. SPRAGUE: Okay. And do you remember, you know, what visiting hours were, or what hours you visited?

8482:34:47

PATRICK CLANCY: I don't remember exactly, but it was, you know, something like 2:00 to 6:00. And I think there were morning hours or... But you couldn't just go any time.

8492:34:55

MS. SPRAGUE: You couldn't, or could?

8502:34:56

PATRICK CLANCY: You could not.

8512:34:56

MS. SPRAGUE: Okay. And so you, out of the few days that she was there, what, five days she was there, you visited two or three times. Is that correct?

8522:35:05
8532:35:06

MS. SPRAGUE: And while you were there with her, did Lindsay talk to you about the treatment that she was receiving at McLean Hospital?

8542:35:17

PATRICK CLANCY: She told me about her experience. It didn't really seem like she was getting any treatment.

8552:35:21

MS. SPRAGUE: Okay. Did she tell you that she wasn't really getting any treatment, or wasn't getting as much care or treatment as she wanted?

8562:35:30

PATRICK CLANCY: Well, I think by the third day, I said, you know, “What have the doctors said?” And she said, “I haven't met with the doctor.” The challenge was she arrived on a Saturday, and then I think Monday was an observed holiday. So she didn't see a doctor until Tuesday. So until then, she was coloring and playing with clay and going for walks.

8572:35:52

MS. SPRAGUE: Were you aware that she was seen by a resident, a doctor, the first two days she was there, and then an attending on the third day that she was there?

8592:36:04

MS. SPRAGUE: Were you aware that she was seen by a licensed social worker, group therapist, and other mental health workers every day while she was there?

8602:36:13

PATRICK CLANCY: Yeah, I didn't get any updates.

8612:36:14

MS. SPRAGUE: Okay. Were you aware that she was offered one-on-one therapy by unit staff every day that she was there?

8632:36:23

MS. SPRAGUE: Did you know that she participated in group therapy on January 1st for 45 minutes, a session about illness and symptom management?

8642:36:32

PATRICK CLANCY: I was aware of some group activities. I didn't know the details of it.

8652:36:36

MS. SPRAGUE: Okay. And were you aware that she participated in two group therapy sessions, one for 45 minutes and one for 50 minutes, one on self-compassion and one on illness and symptom management on January 3rd?

8662:36:48

PATRICK CLANCY: I wasn't aware of the subject of any of the meetings, no.

8672:36:51

MS. SPRAGUE: Were you aware that she declined further group therapy and treatment in the afternoon of January 3rd?

8692:37:00

MS. SPRAGUE: Were you aware that on January 4th she participated in a group for 40 minutes called Medication Management?

8712:37:08

MS. SPRAGUE: Okay. Were you aware that she participated in a group on January 5th on expressive therapy for 45 minutes?

8732:37:15

MS. SPRAGUE: And were you aware that she declined further treatment two times in—on January 5th, one to attend a group therapy and one to attend a session on cognitive behavioral processes?

8752:37:30

MS. SPRAGUE: Were you aware that Lindsay asked the doctors to be discharged on the 6th, Friday the 6th, because she wanted to go to Cora's birthday party on the 7th?

8762:37:40

PATRICK CLANCY: Not that I recall.

8772:37:43

MS. SPRAGUE: Were you aware, or did Lindsay tell you that she then asked the doctors to discharge her on January 5th, because she wanted to go home and get ready for the party?

8782:37:55

PATRICK CLANCY: I wasn't aware of Lindsay asking the doctors to be discharged.

8792:38:00
8802:38:03

MS. SPRAGUE: Were there any insurance issues in terms of insurance refusing to pay for her stay at McLean Hospital?

8812:38:10

PATRICK CLANCY: I... We didn't really get to that point.

8822:38:13

MS. SPRAGUE: You weren't advised by the social worker or any staff there that there were any issues with your insurance. Is that correct?

8832:38:21

PATRICK CLANCY: Yeah, that's correct. But I wouldn't have cared either.

8842:38:24

MS. SPRAGUE: Would you have just paid for it if needed?

8852:38:26

PATRICK CLANCY: I would've paid anything. Yeah.

8862:38:32

THE COURT: Ms. Sprague, is this a good time to break?

8872:38:35
8882:38:35

THE COURT: All right, so members of the jury, we're gonna break for the afternoon recess. And we'll see you back here about 2:00, okay?

8892:38:45

BAILIFF: Court, all rise. You wanna close your notebooks and place them on your chairs.

8902:38:55

BAILIFF: Follow me, please.

8912:39:29

THE COURT: All right. Counsel, anything we need to address before the break?

8922:39:33

MS. SPRAGUE: No, Your Honor.

8932:39:33

THE COURT: All right.

8942:39:33
8952:39:34

THE COURT: So we'll see everybody about 2 o'clock. Thank you.

8962:39:58

BAILIFF: This court is back in session. You may be seated.

8972:40:05

THE COURT: They're coming. All right. Anything we need to talk about before we bring the jury in?

8982:40:10

MS. SPRAGUE: No, Your Honor. Did you want the witness on the stand now or after?

8992:40:14

THE COURT: Well, if he, if... We've got a couple seconds. The jurors are coming in right now. If you wanna have him take the stand, that's fine.

9002:40:44

THE COURT: You'll be seated.

9012:40:56

BAILIFF: All rise.

9022:41:27

BAILIFF: This court's now in session. Please be seated.

9032:41:30

COURT CLERK: Your Honor, for the purpose of the record, we return back to the trial in the matter of Commonwealth versus Lindsay Clancy. All parties are present, including the defendant.

9042:41:37

THE COURT: All right. Thank you. Thank you, members of the jury.

9052:41:39

THE COURT: Ms. Sprague?

9062:41:40

MS. SPRAGUE: Thank you, Your Honor. Sir, before the break, we were talking about Lindsay's stay at McLean Hospital, correct?

9072:41:49
9082:41:50

MS. SPRAGUE: Were you aware that she was discharged on January 5th, 2023?

9092:41:55
9102:41:56

MS. SPRAGUE: And did you in fact bring her home for that day?

9112:41:59

PATRICK CLANCY: I picked her up, yeah.

9122:42:00

MS. SPRAGUE: Okay. Were you aware that she had a follow-up appointment with Dr. Jennifer Tufts the following day?

9132:42:07
9142:42:08
9152:42:18

MS. SPRAGUE: I wanna show you some photos here of the children, and just ask if this is a fair and accurate depiction of how they looked in January of 2023.

9162:42:37
9172:42:39

MS. SPRAGUE: Thank you.

9182:42:43

MS. SPRAGUE: If you could mark this as court exhibits.

9192:42:45

THE COURT: All right. They may be marked.

9202:43:02

COURT REPORTER: Nine through 12.

9212:43:03

MS. SPRAGUE: Thank you.

9222:43:06

MS. SPRAGUE: Sir, showing you exhibit nine. This is Cora, correct?

9232:43:14
9242:43:14

MS. SPRAGUE: Can you tell us a little bit about what Cora was like in January of 2023, what her interests were?

9262:43:22

MR. REDDINGTON: Your Honor, I'm gonna object at this point.

9272:43:25

THE COURT: Counsel, could I see you at sidebar?

9282:44:27

MS. SPRAGUE: So, sir, if you could just tell us a little bit about Cora's interests at that time.

9292:44:33

PATRICK CLANCY: Cora was into princesses.

9302:44:40

PATRICK CLANCY: And she had a lot of friends.

9312:44:46

PATRICK CLANCY: And she just liked taking care of people.

9322:44:51

MS. SPRAGUE: And showing you—

9332:44:56

MS. SPRAGUE: Exhibit 10. Dawson, correct?

9342:44:58
9352:45:00

MS. SPRAGUE: What kind of things was Dawson interested in in 2023?

9362:45:05

PATRICK CLANCY: Using the firefighters and trucks.

9372:45:12

PATRICK CLANCY: And he liked Paw Patrol.

9382:45:19

MS. SPRAGUE: Exhibit 11. Callan was only eight months old, correct?

9392:45:26
9402:45:27

MS. SPRAGUE: Did he have any disorders?

9412:45:31

PATRICK CLANCY: He was just a happy baby.

9422:45:32

MS. SPRAGUE: Happy baby. And then, just showing you quickly Exhibit 12. Does this picture fairly indicate their sizes in relation to each other in January 2023?

9432:45:44
9442:45:58

MS. SPRAGUE: After Lindsay was released from McLean Hospital, was there a birthday party for Cora on January 7th, 2023?

9452:46:08
9462:46:09

MS. SPRAGUE: And who had organized that birthday party?

9472:46:14

PATRICK CLANCY: I think we both did.

9482:46:15

MS. SPRAGUE: Okay. And where was it?

9492:46:19

PATRICK CLANCY: It was at Nova in Plymouth.

9502:46:22

MS. SPRAGUE: And was Lindsay present for the party?

9512:46:25
9522:46:29

MS. SPRAGUE: And do you recall who got all the supplies and everything for the party?

9532:46:34

PATRICK CLANCY: I think Lindsay did.

9542:46:38

MS. SPRAGUE: We could play a video. I'm gonna ask you to look at a video and just tell me if you recognize this as a video from the party.

9552:47:01

MS. SPRAGUE: Or was that from the party?

9562:47:02
9572:47:03

MS. SPRAGUE: And was that Cora seated in front of Lindsay while singing Happy Birthday?

9582:47:07
9592:47:08

MS. SPRAGUE: Okay. And there's a second clip. Again, was that Cora and Lindsay?

9602:47:16
9612:47:21

MS. SPRAGUE: I hope to have the birthday videos as the next exhibit.

9622:47:24

THE COURT: That may be admitted.

9632:47:27

MS. SPRAGUE: Thirteen so far.

9642:47:37

MS. SPRAGUE: From Cora's birthday party until January 23rd, 2023, did you check on and check in with Lindsay?

9652:47:48

PATRICK CLANCY: Every day.

9662:47:49

MS. SPRAGUE: And how did you do that?

9672:47:51

PATRICK CLANCY: I would ask her in the morning how she's feeling, how she slept.

9682:47:56

MS. SPRAGUE: And did she tell you that she was sleeping better?

9692:48:00

PATRICK CLANCY: Maybe a little bit better, but she's still struggling.

9702:48:10

MS. SPRAGUE: And did you ask her during that time if she had suicidal thoughts?

9712:48:16
9722:48:16

MS. SPRAGUE: And what was her response?

9732:48:18

PATRICK CLANCY: She told me no.

9742:48:19

MS. SPRAGUE: She told you what?

9752:48:20

PATRICK CLANCY: She said no.

9762:48:21
9772:48:25

MS. SPRAGUE: Did she ever tell you during that time period that she was having thoughts of harming the children?

9792:48:33

MS. SPRAGUE: Did you, as a family, go to the Museum of Science on January 8th, 2023?

9802:48:38
9812:48:40

MS. SPRAGUE: Was the defendant able to participate in activities with the children while at the museum on January 8th?

9822:48:46
9832:48:51

MS. SPRAGUE: I'm gonna pull up some photographs. Just ask you to ID or identify everyone in the photograph so that the jurors can follow their movements through the video footage and video. So if I may. Down here in the maroon colored shirt?

9842:49:13

PATRICK CLANCY: It's Dawson.

9852:49:14

MS. SPRAGUE: Dawson. Okay. And in the red skirt?

9862:49:17
9872:49:18

MS. SPRAGUE: And in the gray jacket?

9882:49:21
9892:49:22

MS. SPRAGUE: And here, pushing the carriage?

9902:49:24

PATRICK CLANCY: That's me.

9912:49:26

MS. SPRAGUE: Okay. And is Callan in the carriage at that time?

9922:49:28
9932:49:35

MS. SPRAGUE: And permission to play the video, Your Honor?

9942:49:37

THE COURT: Can I see you again at sidebar?

9952:56:58

MS. SPRAGUE: Your Honor, at this time we'd move to submit the still photograph and the video pursuant to the discussion at sidebar. I'd move to submit the full video in as one exhibit for identification and the timeline video as the exhibit.

9962:57:20

THE COURT: Timeline. Did we— are you gonna submit a copy of that later?

9972:57:24

MS. SPRAGUE: No. There's the full video that was provided by the-

9982:57:26

THE COURT: Right.

9992:57:26

MS. SPRAGUE: ... Museum of Science, and then there's a timeline that was created following the family through the museum, and we can get snippets from this video.

10002:57:33

THE COURT: Okay. That's fine.

10012:57:35

MS. SPRAGUE: So for identification.

10022:57:39

COURT REPORTER: Museum of Science videos. Exhibit C, so marked.

10032:57:51

MS. SPRAGUE: And then museum timeline for the next exhibit. Exhibit 14.

10042:58:08

COURT REPORTER: So marked.

10052:58:08

MS. SPRAGUE: Sir, after going to the Museum of Science... Well, let me go back to that for a moment. At the Museum of Science, do you recall the defendant being able to interact with the children at exhibits that required, you know, manipulating knobs and materials, and showing the children how to do those exhibits, and interacting with them at those exhibits?

10062:58:33

PATRICK CLANCY: Yeah. Lindsay was always able to interact with our kids, even including at the Museum of Science.

10072:58:39

MS. SPRAGUE: Okay. And then after your trip to the Museum of Silence- Science, do you remember going to the Charlie Horse restaurant with the kids and Lindsay?

10092:58:48

MS. SPRAGUE: And how soon after the Museum of Science was that, do you recall?

10102:58:54

PATRICK CLANCY: I don't recall the exact dates.

10112:58:56

MS. SPRAGUE: Okay. And what type of place is the Charlie Horse restaurant?

10122:59:00

PATRICK CLANCY: It's like a family restaurant with games.

10132:59:02

MS. SPRAGUE: And how was the defendant's demeanor at the restaurant?

10142:59:08

PATRICK CLANCY: It was good. I was hopeful.

10152:59:11

MS. SPRAGUE: Why were you hopeful?

10162:59:12

PATRICK CLANCY: Because she seemed much better.

10172:59:17

MS. SPRAGUE: And then on January 14th, 2023, were you able to go to brunch with your friends while the defendant was home with the children?

10182:59:28
10192:59:29

MS. SPRAGUE: And about how long were you gone?

10202:59:33

PATRICK CLANCY: About two hours.

10212:59:35

MS. SPRAGUE: Were there any issues or problems that you were aware of while you were gone?

10222:59:39

PATRICK CLANCY: No. She encouraged me to go. She said, "You've just been inside a lot. You should go out." And it was fine.

10232:59:46

MS. SPRAGUE: And while you were there at brunch, did she send you photos of the kids in text messages?

10242:59:53

PATRICK CLANCY: I think so, yeah.

10252:59:59

MS. SPRAGUE: Direct your attention to January 15th, 2023. Did you and Lindsay and the kids go to the Cape Codder in Hyannis?

10263:00:07
10273:00:08

MS. SPRAGUE: And was there a water park there?

10283:00:09
10293:00:11

MS. SPRAGUE: And how was Lindsay's demeanor that day?

10303:00:15

PATRICK CLANCY: It seemed pretty good.

10313:00:16

MS. SPRAGUE: Was she able to interact with the children and participate in the activities?

10333:00:24

MS. SPRAGUE: If I could bring up photos again. I would just like you to look at the photos to point out who the individuals are in the photo. So here, in the dark shorts with the white band on the top?

10343:00:40

PATRICK CLANCY: That's me.

10353:00:42

MS. SPRAGUE: And then in the bathing suit here with the ponytail?

10363:00:45

PATRICK CLANCY: That's Cora.

10373:00:46

MS. SPRAGUE: And then in the striped swimsuit at the bottom?

10383:00:50

PATRICK CLANCY: It's Dawson.

10393:00:56

MS. SPRAGUE: And then here in the black bathing suit without, without shoulder straps?

10403:01:00
10413:01:01

MS. SPRAGUE: Lindsay. And is that, that was Cora with her?

10433:01:09

MS. SPRAGUE: And in this third photo, is that Lindsay with Callan in her arms?

10443:01:13
10453:01:20

MS. SPRAGUE: And that photo there, is that Dawson with the striped bathing suit?

10473:01:25
10483:01:26

MS. SPRAGUE: We can go to the video with the court's permission.

10493:01:29

THE COURT: How long?

10503:01:30

MS. SPRAGUE: I'm just going to go to certain clips. If we could start with, from the beginning to 40 seconds in and play.

10513:01:45

MS. SPRAGUE: Sir, if you could tell us who... Well, can you confirm that that's you and the children and Lindsay arriving now?

10533:02:06

MS. SPRAGUE: Would that be Cora in the purple jacket with the pink boots?

10553:02:09

MS. SPRAGUE: And Lindsay in the gray coat with the backpack?

10573:02:19

MS. SPRAGUE: And then if we could go to 1:39.

10583:03:09

MS. SPRAGUE: And during this time, are you waiting to check in and get your wristbands and all of that?

10593:03:13
10603:03:47

MS. SPRAGUE: You could go to six forty-seven.

10613:03:57

MS. SPRAGUE: Do you recognize this play area?

10633:04:01

MS. SPRAGUE: Mm-hmm. And did you and Lindsay and the children go over to this pirate ship area?

10653:04:07

MS. SPRAGUE: I'm showing you here, is that Cora that just went down the slide?

10663:04:11
10673:04:27

MS. SPRAGUE: And was that you there by the slide?

10683:04:30
10693:04:32

MS. SPRAGUE: We can go to eleven twenty-two.

10703:06:22

MS. SPRAGUE: Bless you. We could go to fourteen oh six. Oh.

10713:07:03

MS. SPRAGUE: Sir, here at sixteen twenty-five, is that Cora and then Lindsay that go down the slide together?

10723:07:11
10733:07:19

MS. SPRAGUE: We can go to seventeen forty-five.

10743:07:27

MS. SPRAGUE: About the same thing here?

10753:07:38
10763:07:39

MS. SPRAGUE: So she's able to interact with Cora and the others, participate in the activities?

10773:07:44
10783:07:46

MS. SPRAGUE: If we could go to forty-seven fifty-three, please.

10793:08:04

MS. SPRAGUE: You're up in the corner here.

10803:08:08
10813:08:08

MS. SPRAGUE: Is this you and Dawson and Cora entering the pool area?

10823:08:11
10833:08:13

MS. SPRAGUE: Lindsay was with Callan at that time, correct?

10853:08:17

MS. SPRAGUE: So you were comfortable with her being off and in a separate area with Callan while you were with Cora and Dawson that day?

10863:08:24
10873:08:25

MS. SPRAGUE: Okay. That's all. Thank you. I move to submit the pod photos and timeline.

10883:08:34

THE COURT: Again, let me just see over here just briefly, just so I have that straight.

10893:09:39

MS. SPRAGUE: So move to admit the exhibit with the guidelines at sidebar.

10903:11:55

THE COURT: All right. Pursuant to our discussion, that portion may be admitted.

10913:12:00

COURT REPORTER: Fifteen, so marked.

10923:12:03

THE COURT: What's that, 15?

10933:12:04

COURT CLERK: Mm-hmm.

10943:12:04

THE COURT: Okay, thank you.

10953:12:08

MS. SPRAGUE: Sir, directing your attention now to January 16th, 2023, did you go skiing that day?

10963:12:18
10973:12:19

MS. SPRAGUE: And who did you go skiing with?

10983:12:21
10993:12:22

MS. SPRAGUE: And was it just the two of you?

11003:12:24

PATRICK CLANCY: No, we went with another dad and his son.

11013:12:27

MS. SPRAGUE: Okay. And who was that dad?

11023:12:29

PATRICK CLANCY: Adam Schwebach.

11033:12:30

MS. SPRAGUE: Okay. And was Lindsay home with Callan and Dawson that day when you went skiing with Cora?

11043:12:39
11053:12:40

MS. SPRAGUE: Okay. Were there any issues or problems that you're aware of when she was home alone with the kids all day?

11073:12:46

MS. SPRAGUE: And was she able to communicate with you throughout the day?

11083:12:51
11093:12:52

MS. SPRAGUE: And how was that communication done?

11103:12:55

PATRICK CLANCY: Texts. I might have called her. I'm not sure.

11113:12:58

MS. SPRAGUE: And do you recall texting each other back and forth photos of you with Cora and the boys at home and what they were doing?

11123:13:07
11133:13:08

MS. SPRAGUE: And so she was able to take those photographs and send them to you without any apparent problem, correct?

11143:13:14
11153:13:23

MS. SPRAGUE: Show you the three text messages with the attached photos. If you could look at those.

11163:13:49

MS. SPRAGUE: Thank you. And sir, are these accurate copies of the text messages with the photos that were sent between yourself and the defendant on January 16th, 2023?

11183:14:03

MS. SPRAGUE: If I could move to have these marked as the next three exhibits, Your Honor.

11193:14:06

THE COURT: They may be admitted.

11203:14:22

COURT REPORTER: Exhibit sixteen, seventeen, and eighteen are marked.

11213:14:32

MS. SPRAGUE: And so sir, showing you the first photo which was marked on exhibit sixteen, did you start off the conversation by sending the photo of you and Cora skiing?

11223:14:45
11233:14:49

MS. SPRAGUE: And showing you exhibit seventeen, did Lindsay respond by taking and sending this photo of Dawson?

11243:14:56
11253:14:59

MS. SPRAGUE: And then did she respond again, sending you a selfie she took of herself and Callan?

11263:15:06
11273:15:16

MS. SPRAGUE: And you felt comfortable leaving Callan and Dawson home with her that day?

11283:15:21
11293:15:21

MS. SPRAGUE: And why is that?

11303:15:23

PATRICK CLANCY: She seemed to be doing a lot better.

11313:15:25

MS. SPRAGUE: In what ways did she seem to be doing better?

11323:15:29

PATRICK CLANCY: Her mood seemed better. She was more active and she was able to partake in more things.

11333:15:38

MS. SPRAGUE: She was also going to the gym during that time as well, correct? The Kingsbury Club.

11343:15:42

PATRICK CLANCY: That sounds right, yeah.

11353:15:50

MS. SPRAGUE: Were you hopeful at that time that things were getting better?

11363:15:54
11373:15:56

MS. SPRAGUE: Did Lindsay's parents visit you the weekend of January 21st through the 22nd?

11383:16:01
11393:16:02

MS. SPRAGUE: And whose idea was that, do you recall?

11403:16:05

PATRICK CLANCY: I think it was theirs. I think they were just coming to visit to say hi.

11413:16:11

MS. SPRAGUE: Okay. And what did you guys do that weekend?

11423:16:15

PATRICK CLANCY: We just hung out and went to a friend's house on Sunday. They left after we got back from there.

11433:16:22

MS. SPRAGUE: And whose friend's house did you go to that Sunday?

11443:16:28

PATRICK CLANCY: The Carney's.

11453:16:29

MS. SPRAGUE: Carney's. Okay. And who went to the Carney's?

11463:16:33

PATRICK CLANCY: Lindsay, myself, Dawson, and Cora.

11473:16:37

MS. SPRAGUE: And what did you do there?

11483:16:40

PATRICK CLANCY: There was a fire, and we were... I think we roasted marshmallows or something like that.

11493:16:45

MS. SPRAGUE: Okay. And how was Lindsay's demeanor that day?

11503:16:50

PATRICK CLANCY: She was quieter that day.

11513:16:51

MS. SPRAGUE: Mm-hmm.

11523:16:52

PATRICK CLANCY: So, I mean, that was the extent of it.

11533:16:55

MS. SPRAGUE: Was she able to interact with the Carney's?

11543:16:59

PATRICK CLANCY: Yeah, but she's quiet.

11553:17:00

MS. SPRAGUE: Okay. And you said you returned home, and then her parents left?

11563:17:05
11573:17:21

MS. SPRAGUE: Do you recall Lindsay and her mom taking a picture together that weekend?

11583:17:25
11593:17:30

MS. SPRAGUE: Is this that photo?

11603:17:30

PATRICK CLANCY: Yeah. That's it.

11613:17:31

MS. SPRAGUE: If I could have this marked as an exhibit.

11623:17:33

THE COURT: It may be admitted.

11633:17:37

COURT REPORTER: Exhibit 19.

11643:17:43

MS. SPRAGUE: And Lindsay seemed to be doing better that weekend, correct?

11653:17:48

PATRICK CLANCY: Overall, yeah.

11663:17:49

MS. SPRAGUE: Were you aware that her mother had sent her a text saying something to the effect of, "I'm glad you're doing so much better"?

11673:17:55

PATRICK CLANCY: I became aware of that later, yeah.

11683:17:58

MS. SPRAGUE: And just showing you Exhibit 19.

11693:18:11

MS. SPRAGUE: And I'm sorry, Your Honor, I didn't mark the still photo from the Museum of Science. If we could have that as an exhibit.

11703:18:16
11713:18:19

COURT REPORTER: Exhibit 20.

11723:18:26

MS. SPRAGUE: Thank you.

11733:18:36

MS. SPRAGUE: That Monday after her parents had gone home to Connecticut, so Monday the 23rd of January, did Cora and Dawson go to school?

11743:18:47
11753:18:48

MS. SPRAGUE: And do you recall Lindsay picking them up that afternoon?

11763:18:53
11773:18:54

MS. SPRAGUE: When Lindsay returned home with Cora and Dawson, did she discuss with you that Cora was having some stomach issues at school?

11783:19:02
11793:19:03

MS. SPRAGUE: And were you familiar with the stomach issues that Cora had been having?

11803:19:07
11813:19:08

MS. SPRAGUE: And did you have an idea of what was causing those stomach issues?

11823:19:14

PATRICK CLANCY: Yeah, it wasn't unusual. She was embarrassed to go to the bathroom at school, so she just held it all day.

11833:19:21

MS. SPRAGUE: Okay. And so this was a common occurrence?

11843:19:24
11853:19:25

MS. SPRAGUE: And were you aware that Cora had her five-year physical scheduled for the next day, Tuesday the 24th?

11863:19:34

PATRICK CLANCY: No, I didn't know that was already scheduled. I thought she, like, called it in and set it up. So yeah, that's news to me.

11873:19:43

MS. SPRAGUE: Okay. So would it have been Lindsay who would make those kinds of appointments, the physicals and all of that?

11883:19:50

PATRICK CLANCY: She usually handled that, yeah.

11893:19:52

MS. SPRAGUE: Okay. And going to Tuesday, January 24th, 2023, were you working that day?

11903:20:03

PATRICK CLANCY: I'm sorry, you said on the 24th?

11913:20:04
11923:20:04
11933:20:04

MS. SPRAGUE: Tuesday the 24th.

11943:20:06
11953:20:07

MS. SPRAGUE: That morning, was Cora's doctor's appointment at 8:00 AM?

11963:20:11
11973:20:12

MS. SPRAGUE: And who took her to the doctor's appointment?

11983:20:14
11993:20:16

MS. SPRAGUE: And did anyone have to go with her, or did she drive herself and Cora there?

12003:20:19

PATRICK CLANCY: It was just Lindsay and Cora.

12013:20:22

MS. SPRAGUE: And you were home with the boys, is that right?

12023:20:24
12033:20:25

MS. SPRAGUE: And while you're with the boys, and Lindsay's with Cora at the doctor's, are you sending text messages and photos back and forth?

12043:20:36
12053:20:38

MS. SPRAGUE: And why did you send a photo of Dawson to Lindsay that morning?

12063:20:43

PATRICK CLANCY: Because he dressed himself completely for the first time.

12073:20:47

MS. SPRAGUE: And he was excited about that?

12083:20:50
12093:20:55

MS. SPRAGUE: And did she respond back with a photo of Cora?

12103:20:59
12113:21:07

MS. SPRAGUE: Are these the photos you sent back and forth?

12123:21:09
12133:21:10

MS. SPRAGUE: If I could have the photo of Dawson as the next exhibit and the photo of Cora as the following.

12143:21:15

THE COURT: All right. They may be admitted.

12153:21:27

MS. SPRAGUE: Is exhibit 21 and 22 somewhere? Just publishing these. Exhibit 21.

12163:21:39

MS. SPRAGUE: And exhibit 22.

12173:21:45

MS. SPRAGUE: And while you were texting with Lindsay back and forth, were you able to understand her text messages?

12183:21:52
12193:21:54

MS. SPRAGUE: Did she seem to understand yours in response?

12213:22:01

MS. SPRAGUE: Did she return home?

12233:22:05

MS. SPRAGUE: And do you recall around what time she got home that morning?

12243:22:11
12253:22:12

MS. SPRAGUE: And once she got home, what did you do?

12263:22:17

PATRICK CLANCY: I think I got ready for work.

12273:22:19

MS. SPRAGUE: And while you were downstairs working in your office, do you know what Lindsay and the kids were doing?

12283:22:31

PATRICK CLANCY: They built a snowman, and they did some art projects.

12293:22:34

MS. SPRAGUE: And how did you know this was happening?

12303:22:36

PATRICK CLANCY: She texted me a picture.

12313:22:38

MS. SPRAGUE: So Lindsay was continuing to text you and send you photographs throughout that day?

12323:22:43

PATRICK CLANCY: Yeah. And I went up to say hi at one point.

12333:22:45
12343:22:58

MS. SPRAGUE: First, I just wanna show you the text messages back and forth. The texts being on the right-hand side. Do you wanna look through there and just see if you recognize the messages going back and forth between you and Lindsay that morning or throughout that day?

12353:23:21

PATRICK CLANCY: Okay. This is—this says activity sensor.

12363:23:26

MS. SPRAGUE: Excuse me?

12373:23:27

PATRICK CLANCY: I think this is something else.

12383:23:32

MS. SPRAGUE: Let's see. So starting at 7:00 AM on the 24th, and we go to 8:17 AM. Is this the photo you sent—

12393:23:41
12403:23:41

MS. SPRAGUE: … to Dawson? And then the replies, going to 8:18 AM. Is this the reply from—

12413:23:51
12423:23:51

MS. SPRAGUE: … Lindsay? And then throughout the day, just messages back and forth, up to the point…

12433:24:10

MS. SPRAGUE: Page 940, where Lindsay's sending you the photos of the kids in the snow. Is that correct?

12443:24:16

PATRICK CLANCY: Yeah. Yeah.

12453:24:16
12463:24:17

MS. SPRAGUE: We could have the text messages marked as the next exhibit.

12473:24:21

THE COURT: Sorry. It may be admitted.

12483:24:26

COURT REPORTER: Exhibit 23.

12493:24:32

MS. SPRAGUE: And just look at one photo. Is this one of the photos she sent?

12503:24:39
12513:24:39

MS. SPRAGUE: We could have the photograph marked as the next exhibit.

12523:24:42

THE COURT: That may be admitted.

12533:24:45

COURT REPORTER: Exhibit 24.

12543:24:54

MS. SPRAGUE: How often do you think you, or do you remember going upstairs that day to interact with Lindsay and the kids?

12553:25:00

PATRICK CLANCY: Once or twice. It was a busier day than usual.

12563:25:07
12573:25:11

MS. SPRAGUE: When you did come up to interact with them, how was Lindsay's mood?

12583:25:16

PATRICK CLANCY: She seemed happy.

12593:25:17

MS. SPRAGUE: Happy? And how could you tell that? What was she doing?

12603:25:22

PATRICK CLANCY: She was playing with the kids, and she seemed in a good mood.

12613:25:29

MS. SPRAGUE: At any point during that day when you came up or while she's texting you, did she tell you she was having suicidal thoughts?

12633:25:36

MS. SPRAGUE: Did she tell you she was having thoughts of harming the kids?

12653:25:40

MS. SPRAGUE: Did she ask for help or anything that caused concern?

12663:25:45

PATRICK CLANCY: No. She was having one of her best days.

12673:25:47

MS. SPRAGUE: One of her best days?

12683:25:55
12693:25:55

MS. SPRAGUE: I wanna direct your attention to 4:53 PM that day. Did you receive a text from Lindsay about dinner?

12703:26:03
12713:26:04

MS. SPRAGUE: And do you recall what it said?

12723:26:06

PATRICK CLANCY: Something along the lines of, "Do you wanna get takeout? I haven't planned anything."

12733:26:11

MS. SPRAGUE: Do you recall it saying, "Any chance you wanna do takeout from 3V? I didn't cook anything. It's been a long day"?

12753:26:21

MS. SPRAGUE: Had you been to 3V Restaurant previously?

12763:26:25
12773:26:26

MS. SPRAGUE: Alone or with the family?

12783:26:28

PATRICK CLANCY: With the family.

12793:26:29

MS. SPRAGUE: And approximately how many times had you been there to eat?

12803:26:32

PATRICK CLANCY: Probably three times.

12813:26:34

MS. SPRAGUE: And so you had all gotten in the car and driven from your home to 3V Restaurant in Plymouth approximately three times?

12823:26:45

PATRICK CLANCY: Yeah. Sometimes we were already out somewhere, but yeah.

12833:26:47

MS. SPRAGUE: Okay. But been there three times?

12843:26:49
12853:26:50

MS. SPRAGUE: Had you ever done takeout from there before?

12873:26:53

MS. SPRAGUE: Where would you typically do takeout when you were gonna do takeout at home?

12883:26:58

PATRICK CLANCY: The Chestnut Grill. I think another one was West End Grill.

12893:27:03

MS. SPRAGUE: Were those closer than 3V to your home?

12903:27:06
12913:27:14

MS. SPRAGUE: So Lindsay suggested 3V, and you agreed. Is that correct?

12923:27:18
12933:27:19

MS. SPRAGUE: Okay. Did she send you another text at 4:56 PM asking you to take a look at the menu?

12943:27:26
12953:27:29

MS. SPRAGUE: And did you send a text at 5:06 PM about Callan?

12963:27:35

PATRICK CLANCY: Yeah. I asked if he had taken a nap.

12973:27:38

MS. SPRAGUE: And did she respond?

12983:27:40
12993:27:40

MS. SPRAGUE: And what was her response?

13003:27:42

PATRICK CLANCY: That it was a shorter nap, and he was awake.

13013:27:45

MS. SPRAGUE: Okay. And at that time, did you also ask—send a separate text asking what she was getting at 3V?

13023:27:52
13033:27:53

MS. SPRAGUE: And what was her response?

13043:27:56

PATRICK CLANCY: I don't remember what she ordered.

13053:28:00

MS. SPRAGUE: Do you recall a Mediterranean Power Bowl?

13063:28:03

PATRICK CLANCY: Yeah, that sounds right.

13073:28:08

MS. SPRAGUE: And did she ask you what you were getting?

13083:28:12
13093:28:13

MS. SPRAGUE: And at 5:08 PM did you respond?

13103:28:16
13113:28:16

MS. SPRAGUE: And what did you tell her?

13123:28:19

PATRICK CLANCY: I forget what it was.

13133:28:21

MS. SPRAGUE: Do you recall scallop and pork belly risotto?

13143:28:24
13153:28:25

MS. SPRAGUE: That was it?

13173:28:29

MS. SPRAGUE: Who called in the order to 3V?

13183:28:31
13193:28:33

MS. SPRAGUE: Once the order was placed, what did you do?

13203:28:37

PATRICK CLANCY: I came upstairs. I took Callan for a minute, and I rocked him by my knees, kissed Cora on the head, and I said, "I'll be right back."

13213:28:49

MS. SPRAGUE: And what was Dawson doing when you were leaving?

13223:28:52

PATRICK CLANCY: He was eating chicken nuggets on the couch.

13233:28:54

MS. SPRAGUE: And do you recall if he was using a bowl or a plate?

13243:28:57

PATRICK CLANCY: It was a bowl.

13253:29:47

MS. SPRAGUE: Do you remember what the defendant's... Well, first of all, where was the defendant seated when you left the house, or was she seated?

13263:29:57

PATRICK CLANCY: She was standing in the doorway.

13273:29:58

MS. SPRAGUE: And where was she?

13283:30:00

PATRICK CLANCY: In the doorway of the living room.

13293:30:03

MS. SPRAGUE: And was that the doorway by the front door or the doorway by the basement door?

13303:30:09

PATRICK CLANCY: It was the doorway by the basement door.

13313:30:11

MS. SPRAGUE: Okay. And did she have Callan or where was Callan?

13323:30:14

PATRICK CLANCY: She had Callan.

13333:30:15

MS. SPRAGUE: Okay. And what was her demeanor?

13343:30:19
13353:30:24

THE COURT: Counsel, could I see both sidebar here?

ProceduralProc.Jury Admonition and Dismissal Until Wednesday
13363:31:30

THE COURT: All right. Members of the jury, we're gonna break at this point for the day. All right? So what we're gonna do is I'm gonna excuse you till Wednesday morning. All right? So you don't have to come in here tomorrow. Just to remind you, I'm gonna ask those same questions I asked you this morning, whether or not you did any research or you saw anything that would affect your ability to remain fair and impartial. You have to keep, still keep an open mind, so don't do any research, don't talk about this case with anyone, don't go online, look at anything, don't take any road trips. And we will see you on Wednesday morning. Same instructions that you got from the officers in regards to that. So again, thank you so much for your time and your effort. And I'll see you on Wednesday. Okay?
