About
Robert Flynn testified for the Commonwealth on Day 5 about securing the house at 47 Summer Street and observing an open bedroom window. The Duxbury officer described a three-officer sweep for people rather than evidence. He said nothing was touched or moved during that sweep and described an entry log, crime scene tape, and secured doors pending state police arrival.
Flynn recalled a takeout bag, snacks on the couch, and a phone on the bed. He described a colder bedroom with an open window and a screen that appeared pushed up. After the warrant search, he moved the bed to close the window and observed no damage to the window or screen. He said he was present during the search but was not assigned to search a location or collect evidence; medical equipment was the only material he removed, during the search.
Flynn distinguished his initial belief that the children remained inside from later information that they had been transported. He also corrected counsel's premise by saying Patrick Clancy was still at the scene when he arrived. During Shanan Buckingham's examination, the court admitted kitchen photograph exhibit 44 after Flynn confirmed its depiction. Defense counsel declined cross-examination.
